DESCRIPTION
Under general direction, to implement and administer a program of compliance with equal opportunity regulations and policies for construction,  goods and services, architectural and engineering, and professional services contracts; to promote County contracting opportunities through outreach to the local, small, women- and minority-owned business community; to monitor effective compliance, recommend appropriate action to effect compliance and to seek appropriate measures for non-compliance with County equity programs; to perform periodic review and recommend updates/enhancements to programs, policies, and procedures; and to perform related duties as required.

DISTINGUISHING FEATURES

This classification is located in the General Services and Public Works Agencies.  Each position is responsible for developing, administering, implementing, and monitoring outreach and equity programs to ensure that all procedures are followed for procurements and contracts within the Agency, and to review contracts and procurement documents for compliance with Federal and State contracting and labor codes.  The position is responsible for monitoring and compliance in the administration of contracts and for the enforcement of sanctions against violating contractors.  The Contract Compliance Officer’s functions are independent of those of the project and construction managers.  It is distinguished from the Diversity Programs Manager and Assistant Diversity Programs Manager, County Administrator's Office, in that they have county-wide responsibility for investigation of complaints.

EXAMPLES OF DUTIES
NOTE: The following are the duties performed by employees in this classification.  However, employees may perform other related duties at an equivalent level.  Each individual in the classification does not necessarily perform all duties listed.

  1. Implements and administers Agency contract/labor compliance policy/program, procedures and systems and reviews to determine their effectiveness.
  2. Develops, implements, operates, and maintains outreach programs for local, small, women- and minority-owned businesses for participation in construction, goods and services, architectural and engineering, and professional service contracts.
  3. Supervises the maintenance of a local, small, women and minority database; compiles and analyzes data on participation by M/WDBE, ethnic background of workers by craft, and financial participation by minority and women-owned businesses; prepares related statistical reports.
  4. Trains and orients contractors and agency staff with the process/procedures of contract/labor compliance and assists contractors regarding doing business with the County.
  5. Presents County equity programs and associated requirements at pre-solicitation meetings for all procurements.
  6. Keeps abreast of, and monitors compliance with, Federal, State, and County contracting rules, regulations, policies, and procedures; recommends program updates, modifications, and enhancements as needed.
  7.  Reviews RFPs and RFQs to ensure that solicitations include all necessary Public Contract Code, Labor Code, and County equity program provisions.
  8. Promotes County contracting opportunities through outreach, vendor education, and technical assistance efforts so that underutilized businesses are trained and prepared to compete for County projects.
  9. Investigates complaints from businesses, community groups, vendors,  contractors, and their employees at job sites.
  10. Serves as a liaison on contract/labor compliance matters with the Diversity Program’s Manager, other County departments, and outside agencies.
  11. Coordinates and manages services provided by consultants in relation to outreach, technical assistance, project labor agreements, and contract and labor compliance.
  12. Provides training, technical assistance, and resources to contractors, agency staff, and others, as needed.
  13. Provides advice and direction on financing, bonding, and insurance requirements.
  14. Provides program direction to County staff and others, and acts as liaison on outreach.  Represents Agency and County on committees, with community and trade organizations at meetings, hearings, and presentations.
  15. Assists with other County departments and Agency staff as required to prepare Requests for Proposal, bids, contracts, and related services.
  16. Ensures post-award administration of contracts and monitors performance of the requirements and scope of the contracts to ensure compliance with Federal, State, and County rules, policies, and procedures, including permitting requirements.
  17. Compiles data and prepares various reports, as needed.

MINIMUM QUALIFICATIONS
EITHER I
Experience

The equivalent of two (2) years of full-time experience of or higher than the class of Administrative Specialist II in the Alameda County classified service.

OR II
Education

Possession of a bachelor’s degree from an accredited college or university in public or business administration, or a related field. 

AND
Experience

The equivalent of four (4) years of full-time, increasingly responsible experience in the field of construction management, contract compliance, equity programs or industrial relations which includes oversight and coordination of outreach and contract administration projects.

License:

Possession of a valid California Motor Vehicle Operator’s license.

Special Requirements:

Must be willing to travel to various locations within and outside the County and attend meetings/events outside of the standard business hours.

NOTE: The Civil Service Commission may modify the above Minimum Qualifications in the announcement of an examination.

KNOWLEDGE AND SKILLS

Knowledge of:

  • Employment and labor practices and minority business conditions in the Bay Area.
  • Codes, statutes, and laws related to equal employment and business development in public procurement (construction and good and services).
  • Practices of public procurement and the administration of equity programs
  • Federal, State, and local codes, statutes, laws, and regulations related to public procurement and contracting. Contractual agreements related to public contracting, including DIR requirements, prevailing wage, etc.
  • Procedures and guidelines used to investigate employment and business practices.
  • Business and political networks within the vendor community.
  • Contract administration and management.
  • Computer databases and applications related to the work.
Ability to:

  • Understand, interpret, and apply legislation, laws, rules, and regulations.
  • Analyze operations and procedures in order to improve and make recommendations.
  • Plan, organize, and direct equity and outreach programs with department staff, union representatives, and members of the small, local, and diverse business community. 
  • Establish effective working relationships with coworkers, trade and business organizations, and members of the community.
  • Speak effectively before groups.
  • Keep abreast of developments in the field of public procurement and Contract/Labor Compliance.
  • Set up methods for effective monitoring of projects from inception through completion.
  • Prepare clear and concise reports and provide meaningful analysis of the information.
  • Use applicable computer databases and applications related to the work.
  • Assign and supervise the work of other employees.
  • Maintain effective communication and working relationship with governing boards, contractors, and a variety of management positions while maintaining objectivity amongst all groups.
  • Address delicate or sensitive issues in a tactful, effective manner.
