PURPOSE OF JOB CLASS (NATURE OF WORK)

In the Department of Banking, Consumer Credit Division this class is accountable for administering the programs and operations of the division.

SUPERVISION RECEIVED

Receives executive direction from the Commissioner, Deputy Commissioner or other administrative official of higher grade.

SUPERVISION EXERCISED

Administers programs and operations of division; directs all staff.

EXAMPLES OF DUTIES

  • Administers staff and operations of the division;
  • Coordinates, plans and manages division activities;
  • Formulates program goals and objectives;
  • Develops or assists in development of related policy;
  • Interprets and administers pertinent laws;
  • Evaluates staff;
  • Prepares or assists in preparation of division budget;
  • Maintains contacts with individuals within and outside of division who might impact on policy or program activities;
  • Directs examinations of consumer collection agencies, small loan licensees, sales finance companies, second mortgage licensees, debt adjusters and those grantors of consumer credit not federally chartered;
  • Directs preparation of economic surveys for use of banking commission in considering new small loan applications;
  • Directs investigation required in connection with new and renewal applications for grantors of consumer credit, collection agencies and debt adjusters;
  • Directs investigation of all complaints regarding violations of Truth in Lending Act and other laws and regulations over which the Banking Department has jurisdiction working with the Office of the Attorney General and Department of Emergency Services and Public Protection in prosecution of such complaints;
  • Conducts hearings whenever necessary in connection with enforcement of laws;
  • Addresses various industry groups and civic organizations in connection with educational programs;
  • Leads the recruitment and hiring of staff, including outreach, interview and selection;
  • Performs related duties as required.

    • various methods of granting of credit by businesses of all types;

    • evaluate effect of trends and policies in granting of credit on economy of the state;

MINIMUM QUALIFICATIONS - GENERAL EXPERIENCE

Ten (10) years of experience involving technical work in the management or examination of grantors of consumer credit, consumer collection agencies, debt adjusters and /or consumer credit trade organizations, including experience in Truth in Lending compliance.

MINIMUM QUALIFICATIONS - SPECIAL EXPERIENCE

Two (2) years of the General Experience must have been in a working lead capacity over professional staff at the level of a Principal Financial Examiner.

MINIMUM QUALIFICATIONS - SUBSTITUTIONS ALLOWED

  • College training in accounting, finance or a related field may be substituted for the General Experience on the basis of fifteen (15) semester hours equalling one-half (1/2) year of experience to a maximum of four (4) years for a Bachelor's degree.
  • A Master's degree in business, accounting, finance or a closely related field may be substituted for one (1) additional year of the General Experience.
