Incumbents appraise, negotiate, provide technical, relocation, property management or administrative support services related to the acquisition and disposition of real property and property rights for state highway purposes.
Nature and Scope
Incumbents independently complete difficult assignments in one of the primary specialities of right-of-way operations while at the same time are able to complete noncomplex assignments in one or more of the remaining right-of-way specialities. Supervision received in the employee's area of specialization is limited largely to review of work product. Training and guidance is provided for complex assignments in secondary areas of operation. Emphasis will be placed upon the development of a well rounded Right-of-Way Agent. Under the general supervision of a Senior Agent, the Right-of-Way II may serve as a short-term group leader to complete specific assignments within their own area of specialization.

Appraisal - Appraises properties in accordance with established practices.
Reviews appraisals as assigned for acceptability.
Testifies in court as an appraisal witness.
Negotiates for property, or relocates owners and tenants, or provides technical services as assigned.
Negotiations - Interprets and explains right-of-way plans and construction plans for property owners, and communicates what effects right-of-way acquisition and construction will have on their properties.
Explains the laws, regulations, and policies under which real properties are acquired for public purposes including alternatives available to owners.
Identifies changes owners would like made in construction plans, and works with project designers and owners until questions are resolved.
Negotiates for purchases of properties at approved appraised values, and processes the legal instruments required for ownership transfers.
Appraises properties, relocates owners and tenants for right-of-way acquisitions, and provides technical services as assigned.
Relocation - Identifies comparable and available homes, farms, and business establishments to which owners and tenants who will be displaced can be relocated.
Explains available relocation benefits, and payments that can be reimbursed.
Determines payments that will be made to owners of farms and businesses that decide to terminate operations in lieu of relocating.
Appraises and negotiates for real properties, and provides technical services as assigned.
Technical Services (Right-of-Way Plans) - Researches, interprets and provides right-of-way and property data for plan preparation.
Reviews plans for accuracy and content and provides technical assistance during plan development.
Conducts field inspections, measures property and improvements, prepares scale drawings and writes property descriptions.
Appraises and negotiates for real property acquisition, relocates owners and tenants as assigned.
Administrative or Property Management - Negotiates for the lease or sale of real property.
Arranges for the maintenance, protection and sale of buildings in the right-of-way and effects the clearance of the right-of-way.
Prepares estimates for the cost of demolition, removal, or rehabilitation of structures, determines salvage and retention values.
Coordinates the fiscal requirements of the right-of-way operation.
Appraises, negotiates for real property acquisition, relocates owners and tenants and provides technical services as assigned.
All Specialities - Coordinates with other Department sections to obtain and clear right-of-way in time to permit the Department's Bridge and Highway Program to proceed on schedule.

Ability, as a specialist in appraisals, or negotiations, or relocations, or technical services, to complete standard assignments in other right-of-way specialities independently.
Ability to assist location, environmental, and design specialists with respect to right-of-way considerations.
Ability to establish and maintain an effective working relationship with other Department sections, other agency officials and the public.
Job Requirements
JOB REQUIREMENTS for Right-of-Way Agent II
Applicants must have education, training and/or experience demonstrating competence in each of the following areas:
Six months experience in real estate such as appraisal, law, real property acquisition, property management or title examination.
Six months experience in analyzing engineering or property drawings.
Six months experience in real estate negotiation.
Six months experience in interpreting laws, rules, regulations, standards, policies, and procedures.
Six months experience in narrative report writing.
