Summary Statement

Incumbents are highly skilled Right-of-Way Agents who appraise, review appraise, negotiate, provide technical, relocation, property management or administrative support services related to the acquisition and disposition of real property and property rights for State highway purposes.

Nature and Scope

A class incumbent independently and consistently complete complex assignments in two or more of the operational specialties of the Right-of-Way Section. They also complete or have demonstrated the ability to complete standard work assignments in the remaining specialties or perform comparable administrative work. Independent performance of all assignments is critical. An incumbent may be assigned supervisory duties over lower grade agents for the purpose of training and the completion of project assignments.

Essential Functions

  • Appraises all types of properties and reviews appraisals for acceptability.
     
  • Manages the Property Management Operation.
     
  • Serves as a project leader in carrying out appraisal, negotiation, relocation, administrative and fiscal functions for projects significant in size.
     
  • Coordinates with other Department sections to obtain and clear right-of-way in time to permit the Department's Bridge and Highway Program to proceed on schedule.

Knowledge, Skills and Abilities

The intent of the listed knowledge, skills and abilities is to give a general indication of the core requirements for all positions in the class series; therefore, the KSA’s listed are not exhaustive or necessarily inclusive of the requirements of every position in the class.
  • Knowledge of the organization of the Division of Highways and Federal Highway Administration and of procedures relating to the acquisition of right-of-way.
  • Knowledge of highway construction and maintenance as related to right-of-way.
  • Knowledge of the theories of land economics, land development, and real estate investment practices.
  • Knowledge of federal and state laws and departmental policies and procedures relevant to the particular disciplines of right-of-way specialization including the practice of eminent domain.
  • Knowledge of the negotiations and communications process.
  • Ability to manage rental properties, develop leases, and to coordinate the removal of structures from lands needed for highway purposes.
  • Ability to analyze complex situations, and carry out or recommend effective courses of action.
  • Ability to effectively coordinate and apply the Division's relocation assistance and advisory program.
  • Ability to complete complex real property appraisals including the determination of severance damages and consideration of offsetting special benefits.
  • Ability to establish and maintain an effective working relationship with other Department sections, other agencies and the public.

Job Requirements

JOB REQUIREMENTS for Right-of-Way Agent III
Applicants must have education, training and/or experience demonstrating competence in each of the following areas:

  1. Three years experience in real estate such as appraisal, law, real property acquisition, property management or title examination.
  2. Six months experience in interpreting the Federal Uniform Relocation and Real Property Acquisition Act.
  3. Three years experience in real estate negotiation. 
  4. Three years experience in analyzing engineering or property drawings.
  5. Six months experience in relocation assistance.
  6. Six months experience in narrative report writing.
