Description of Occupational Work

This class series uses two levels in the Administrative Services occupational group, Legal Services occupational series and describes professional legal services work researching, drafting and analyzing legislation to be presented for consideration by the Delaware General Assembly.

Essential Functions

Essential functions are fundamental, core functions common to all positions in the class series and are not intended to be an exhaustive list of all job duties for any one position in the class. Since class specifications are descriptive and not restrictive, incumbents can complete job duties of similar kind not specifically listed here.

  • Drafts legislation and amendments to legislation.
     
  • Proofs bills that have been drafted or amended during the legislative process and identifies any technical or substantive errors or oversights found.
     
  • Researches and analyzes legislation.
     
  • Performs legal and general research and drafts legal and research memoranda.
     
  • Provides the legal expertise to analyze complex, technical legislation and determine constitutionality of same.
     
  • Acts as non-partisan legal staff to the General Assembly.
     
  • Testifies before the General Assembly, party caucuses and special interest groups.
     
  • Provides expertise and acts as resource person for various committees and executives in other State government organizations.

Levels of Work

Legislative Attorney

This is the first level in the series.

  • Reports to an administrative superior. 
  • Performs the full range of Essential Functions.

Senior Legislative Attorney

This is the lead level in the series.

  • Oversees and reviews the work of and provides technical guidance and direction to other attorneys, paralegals, or other administrative or technical support staff.
  • Performs the full range of Essential Functions for the most complex, technical issues/legislation.

Knowledge, Skills and Abilities

The intent of the listed knowledge, skills and abilities is to give a general indication of the core requirements for all positions in the class series; therefore, the KSA’s listed are not exhaustive or necessarily inclusive of the requirements of every position in the class.

  • Knowledge of the Delaware Code, Constitutional Law and federal and state regulations.
  • Knowledge of research techniques and evaluation.
  • Knowledge of the political process and its implications in state government.
  • Ability to exercise independent judgment in evaluating situations and making decisions and function both independently and in a team environment.
  • Ability to remain neutral in a political environment.
  • Ability to actively and effectively communicate with legislators, legislative staff, and others as needed to ensure the efficient execution of work-related duties and the maintenance of good working relationships.
  • Ability to acquire and develop an understanding of legislative drafting rules and the rules of statutory construction.
  • Ability to use a computer to draft legislation or other documents, perform research, track legislation, and engage in professional communications.
  • Ability to prioritize multiple tasks, work efficiently within time constraints and deadlines, and handle stressful situations.

In addition to the above knowledge, skills and abilities, the Senior Legislative Attorney requires:

  • Skill in interpreting and applying the Delaware Code, Constitutional Law, and federal and state regulations.
  • Skill in researching, analyzing and evaluating the most complex situations and information to determine course of action.
  • Skill in organizing and presenting information in a clear and logical form for oral and written presentation.
  • Ability to oversee the work of and provide technical guidance and direction to other attorneys, paralegals, or other administrative or technical support personnel.  

Job Requirements

JOB REQUIREMENTS for Legislative Attorney
Applicants must have education, training and/or experience demonstrating competence in each of the following areas:

  1. Possession of a Juris Doctor.
  2. Possession of a valid license to practice law.
  3. Three years experience in researching and interpreting regulatory, constitutional, statutory and case law.
  4. Three years experience in analyzing and evaluating public policies and making recommendations based on findings.
  5. Six months experience in narrative report writing.
