This class series uses three levels of work in the Public Safety occupational group, Motor Vehicle Services occupational series and describes Motor Vehicle Code enforcement work pertaining to driver licensing.

The career ladder incorporates the Driver Improvement Associate and Driver Improvement Hearing Associate; therefore, all positions allocated into the career ladder are classified at the Driver Improvement Hearing Associate level (highest level in the career ladder). The Driver Improvement Associate level is to provide entry for hiring new employees into the class series but does not preclude hiring new employees at higher levels. Employees may be promoted through the career ladder in accordance with job requirements and promotional standards. Promotional standards, a selection document under separate cover, sets forth the criteria that defines and describes the requirements that must be met at each level. Advancement of employees through the career ladder is dependent on an agency's/department's operational needs and distribution of work.

The Driver Improvement Assistant/Hearing Officer level, although not part of the career ladder, provides competitive opportunity for movement of employees.

Essential functions are fundamental, core functions common to all positions in the class series and are not intended to be an exhaustive list of all job duties for any one position in the class. Since class specifications are descriptive and not restrictive, incumbents can complete job duties of similar kind not specifically listed here.

• Interviews individuals whose license is to be suspended, revoked or reinstated to gather information concerning behavior relative to the use of alcohol and/or drugs. Investigates the background of violators. Informs individual of entries on driving record; resolves discrepancies on driving records; advises individuals of consequences of violations. 
   
• Determines course(s) of action to take on an individual's license such as suspend, re- examine, restrict license, reinstate license, refer to special programs based on information collected from the interview or investigation and the Motor Vehicle laws, rules and regulations and takes necessary action.  
   
• Conducts special interviews based on requests from family members, physicians or law enforcement officials to determine person's capabilities to operate a motor vehicle; reviews physician's findings; determines whether further testing is necessary; explains to driver why they failed test; makes recommendations for special equipment to aid driver. 
   
• Prepares reports of investigations, interviews and/or hearings to document facts and circumstances of the case, action taken and reasons. Testifies in court regarding case decisions.
   
• Processes a variety of transactions such as suspending, and/or revoking driver, identity, and motor vehicle credentials; accessing driving records; assessing fines and penalties; and reviewing customer history to identify outstanding warrants, suspensions, revocations, and/or disqualifications to driver licenses/IDs issued by other jurisdictions.
   
• Delivers excellent customer service to internal and external customers by obtaining business, personal, and/or sensitive information in order to assist customers with all transactions necessary to resolve issues. 
   
• Identifies situations outside of standard operating procedures and makes recommendations for exceptions in accordance with laws, rules, regulations, policies, processes, and procedures, while safeguarding customer’s identity. 
   
• Accurately computes, handles, and accounts for all DMV monies collected and disbursed for transactions including, but not exclusively driver improvement fees and penalties and driving records. Ensures all fees and deposits are reconciled and deposited correctly.
   
• Interprets, applies, and explains driver, identity, and motor vehicle federal, state, and division laws, rules, regulations, policies, processes, procedures, programs, and eligibility to the public, attorneys, lien and insurance companies, court and law enforcement personnel, automobile dealers, government agencies, businesses, and other states’ jurisdictions. Accesses various manual, computerized, and specialized systems simultaneously to review and analyze source documents, determine customer’s eligibility for services, and complete transactions accurately and within any established service levels.
   
• Researches, evaluates, analyzes, and uses judgment to resolve discrepancies, identify exceptions, and render decisions.
   
• Answers customer questions and completes transactions for non-DMV services including warrant resolutions and court transactions.
   
• Prepares a variety of records and reports.

Driver Improvement Associate

This level is responsible for performing the full range of essential functions.

• Reports to the Motor Vehicle Program Manager.
• Contacts include violators, doctors, general public, law enforcement agencies, attorneys, legislators, other states and court personnel to collect/clarify information, explain driving violations, resolve discrepancies on driving records and explain Motor Vehicle laws, rules, regulations, policies and procedures.
• Independently resolves moderately complex discrepancies, customer issues, complaints/problems and escalates highly complex issues.
• Reviews, analyzes, and processes a variety of complex legal/source documents, ensuring that documents contain required information, are acceptable for use and are not fraudulent.
• Processes transactions and administers testing while obtaining specific certification such as CJIS.
• May assist other functional areas as the operational need demands.

Driver Improvement Hearing Associate

This level is responsible for enforcement work conducting investigations and administrative hearings pertaining to infractions of the Motor Vehicle Code.

• Conducts and regulates administrative hearings with violators, attorneys and law enforcement officers to determine if the suspension or revocation was accomplished in conformance to the Motor Vehicle Code.
• Evaluates information and renders decisions pertaining to suspension, revocation and conditional/reinstatement of revoked driver licenses based on evidence, testimony, researched cases/laws cited and/or investigations in accordance with established Motor Vehicle laws, rules, regulations and procedures.
• Contacts include violators, physicians, attorneys, witnesses, law enforcement officers, court officials, character references, DUI program personnel and the public to explain the Motor Vehicle administrative hearing, driver improvement and licensing laws, rules, regulations, policies and procedures.
• Independently resolves highly complex discrepancies, customer issues, complaints/problems and escalates the most complex issues.
• Possesses CJIS or similar certification.

Driver Improvement Assistant/Hearing Officer

This level is responsible for assisting the Motor Vehicle Program Manager in managing statewide driver improvement operations; and is conducting, medical record reviews, administrative hearings and interviews in the enforcement of Motor Vehicle laws, rules and regulations and performing administrative services enabling superiors to establish or amend rules, regulations, standardized procedures, forms and manuals.

• Supervises technical, administrative support and/or seasonal employees.  Supervision is exercised over two or more merit full time positions per the Merit Rules.  The elements of supervision include planning, assigning, reviewing and evaluating performance, training and recommending hire, termination and discipline.
• Researches, analyzes and evaluates legal, technical and administrative materials; recommends new or changes to driver improvement rules, regulations, policies, procedures, forms and manuals; drafts procedures, forms and manuals; participates in interviewing process; prepares correspondence for superiors.
• Provides technical expertise in a multitude of and often complex laws and regulations governing driver licensing and improvement and is responsible for recommending and implementing new and/or revised laws, rules, regulations, policies and procedures.
• Conducts and regulates administrative hearings with violators, attorneys and law enforcement officers to determine if the suspension or revocation was accomplished in conformance to the Motor Vehicle Code.
• Monitors, evaluates and analyzes statewide Driver Improvement operations by reviewing statistical data, responding to complaints, reviewing reports of staff activities in order to determine compliance with regulatory requirements, effectiveness of programs and operations and uniformity of staff decisions in applying laws, rules, regulations, policies and procedures.
• Evaluates information and renders decisions pertaining to suspension, revocation, and conditional/reinstatement of revoked drivers licenses based on evidence, testimony, researched cases/laws cited, investigations and/or interviews in accordance with established Motor Vehicle laws, rules, regulations, policies and procedures. 
• Reviews, evaluates and analyzes existing, proposed and newly enacted laws; advises superior on feasibility of implementation and impact on current laws, rules, regulations, programs and operations; drafts new or amended legislation, regulations, policies and procedures; recommends and implements operational changes.
• Contacts include violators, physicians, attorneys, witnesses, law enforcement officers, legislators, court officials, character references, DUI program personnel and the public to explain the Motor Vehicle administrative hearing, driver improvement and licensing laws, rules, regulations, policies and procedures. Maintains constant contact with other states’ motor vehicle personnel to resolve complaints, interpret, clarify and explain motor vehicle laws, rules, regulations, policies, procedures and substantiate enforcement staff decisions.

In addition to the above knowledge, skills and abilities, the Driver Improvement Hearing Associate requires:

• Knowledge of statutory and case law relating to DUI.
• Knowledge of quasi-judicial proceedings including the rules of admissible evidence and testimony. 
• Knowledge of investigative methods and techniques involving sensitive and confidential information. 
• Knowledge of legal terminology.
• Skill in rendering decisions based upon testimony given, evidence presented and applicable laws, precedents, etc.
• Ability to mediate disputes arising during the processing of charges between adversarial parties.
• Ability to research, analyze and evaluate information including case law, draw logical conclusions and render fair and justifiable decisions.
• Ability to interpret legal decisions as they relate to specific cases.

In addition to the above knowledge, skills and abilities, the Driver Improvement Assistant/Hearing Officer requires:

• Knowledge of the organization, functions, programs, responsibilities and procedures of driver improvement.
• Knowledge of judicial proceedings including presenting testimony. 
• Knowledge of descriptive statistics.
• Knowledge of principles and practices of supervision.
• Skill in establishing and maintaining effective working relationships with attorneys, legislators, law-enforcement and court officials, other states motor vehicle personnel, employees, physicians, and the public.
• Skill in the interpretation and application of statutory, regulatory and administrative requirements.
• Skill in organizing, directing and coordinating people and functions. 
• Ability to analyze and evaluate laws, rules, regulations, policies, procedures, programs and operations and recommend and implement changes. 
• Ability to identify problems, create and implement solutions.
• Ability to develop and write procedures, forms and manuals involving legal statutes and mandates.

JOB REQUIREMENTS for Driver Improvement Associate
Applicants must have education, training and/or experience demonstrating competence in each of the following areas:

1. Six months experience in driver licensing and driver improvement.
2. Six months experience in interpreting motor vehicle laws, rules, regulations, standards, policies and procedures.
3. Six months experience in interviewing which includes using structured or unstructured interview techniques to obtain facts, explore issues and identify courses of action.
4. Six months experience in using an automated information system to enter, update, modify, delete, retrieve/inquire and report on data.
5. Six months experience in narrative report writing.
6. Knowledge of quasi-judicial proceedings.
7. Possession of a valid Driver's License (not suspended, revoked or cancelled, or disqualified from driving).
