A class incumbent directs and administers the State Labor Law Enforcement program.
Oversees 2 supervisory and 14 labor law enforcement employees and 3 clerical support positions.
Nature and Scope
A class incumbent performs with general direction from the Division Director, Industrial Affairs and is responsible for directing the proactive application, administration and enforcement of State and Federal labor standards, labor relations and civil rights laws including but not limited to wage payment laws, child labor, clean indoor air, and state and federal anti discrimination statutes. The Administrator evaluates the needs of the employment community, and plans and develops an enforcement operation to visit types of businesses for which problems have been identified. The incumbent monitors and directs the Equal Employment Opportunity functions for compliance with the technical and legal requirements of the intake process and formulation of a legally sufficient charge of discrimination. The incumbent assists the Director of the Division of Industrial Affairs, as a team member, in the development of division policy, the legislative program and the long term strategic plan. Serves as primary technical resource on labor standards, labor relations and civil rights laws for employers, employees, state legislators, unions, federal, state and local officials and the public.

Plans and directs activities of the Labor Law Enforcement Section; plans and implements large scale enforcement operations; makes case referrals to Attorney Generals Office for legal action; establishes/revises policies, procedures, priorities, programs and strategies; prepares budget requests; delivers speeches and presentations; works with other states and national organizations to develop more effective enforcement programs; attends local, regional and national conferences in order to keep abreast of laws, regulations, and programs.
Serves as liaison with EEOC regarding funding for cases and the preparation and handling of cases. Negotiates contract and administers the worksharing agreement with the Equal Employment Opportunity Commission.
Oversees the work of subordinate supervisors engaged in the enforcement of state labor standards, labor relations and civil rights laws; plans and conducts special training programs regarding the interpretation of new and/or revised labor laws, rules, regulations, Attorney General opinions, policies and procedures.
Participates in the preparation of the Division's budget and strategic plan.
Analyzes new or revised federal labor standard laws, labor relations laws and civil rights laws; legislation; drafts or amends state laws and develops or modifies program operations to implement changes; may testify before legislature; may hold public hearings as the Secretary of Labor's designee.
Establishes prevailing wage rates paid to employees on state funded construction projects.
Meets with Attorney General's Office to discuss more difficult interpretations of law and cases that have been referred; completes affidavits or testifies in state and federal courts regarding provisions of law and investigations conducted.
Plans and oversees the activities of the Governor's Council on Labor, Prevailing Wage Task Force and the Equal Employment Opportunity Review Board; provides advisory and administrative support for their activities.

JOB REQUIREMENTS for Administrator, Labor Law Enforcement
Applicants must have education, training and/or experience demonstrating competence in each of the following areas:
Six months experience in program administration such as overseeing and directing the development, implementation and evaluation of programs and services; planning and establishing short and long range program goals and objectives. Providing advice to other agency organizational units through consultation.
Three years experience in enforcing and determining compliance with labor or employment laws, rules, regulations, standards, policies and procedures.
Six months experience in developing policies and procedures.
Knowledge of operations management which includes planning, directing, coordinating, controlling and evaluating operations typically through subordinate supervisors.
