This class series uses three levels in the Agriculture, Natural Resources and Sciences occupational group, Agriculture and Animal Services occupational series and describes inspection and testing work done in regulating all commercial transactions involving weighing or measuring; regulating all devices used commercially to determine weight, measure or count; and enforcing the Delaware Packaging and Labeling Regulations.

Note: This career ladder series incorporates levels I and II.  The I level is to provide entry for hiring new employees into the class series but does not preclude hiring new employees at higher levels. Employees may be promoted through the career ladder in accordance with minimum qualifications and promotional standards. Promotional standards, a selection document under separate cover, sets forth the criteria that defines and describes the requirements that must be met at each level. Advancement of employees through the career ladder is dependent on an agency's/department's operational needs and distribution of work. 

The Weights and Measures Supervisor and Weights and Measures Administrator levels, although not part of the career ladder, provide competitive opportunity for movement of employees. 

Essential functions are fundamental, core functions common to all positions in the class series and are not intended to be an exhaustive list of all job duties for any one position in the class. Since class specifications are descriptive and not restrictive, incumbents can complete job duties of similar kind not specifically listed here.

• Tests retail store scales, large platform scales and motor truck scales up to a capacity of 150,000 pounds.
   
• Tests flow meter devices such as gasoline pumps, fuel oil truck meters and propane meters.
   
• Tests packaged and canned items for net weight as stated in the label.
   
• Performs mathematics such as calculating percentages and averages.
   
• Explains statutory requirements and test procedures to owners and managers of businesses.
   
• Takes appropriate action in cases of violations, mislabeled products removed from shelves and inaccurate devices ordered to be repaired. Suspected fraud is reported to supervisor for possible criminal action.
   
• May appear in court as a witness.
   
• May participate in fraud investigations.
   
• Prepares reports and keeps records.

Weights and Measures Inspector I

This is entry level inspection and testing work.

• Receives close technical supervision.
• Receives on-the-job training in the techniques used to test a wide variety of metering and weighing equipment.
• Performs the full range of essential functions.

Weights and Measures Inspector II

This is full performance inspection and testing work.

• Performs the full range of inspection and testing duties with minimal supervision.
• Inspects a large variety of weighing, scanning, timing, measuring and metering devices to ensure accuracy of operation.
• Takes appropriate action in cases of violations including issuing criminal citations, ordering products off sale, and removing weighing/measuring devices from commercial use.
• Participates in investigations into consumer complaints and violations identified during inspections. Gathers and secures physical and photographic evidence, develops cases and provides court testimony in criminal cases.
• Explains statutory requirements, inspection and testing procedures to owners and managers of businesses. Issues criminal summonses for repeated infractions.
• Prepares and presents educational programs to consumers and business through group presentations, exhibits and personal contacts.
• May train lower level inspectors.

Weights and Measures Supervisor

This level is responsible for conducting and supervising inspection and compliance work.

• Supervision is exercised over at least two or more merit full time positions per Merit Rule 5.1460. The elements of supervision include planning, assigning, reviewing, evaluating, coaching, training, recommending hire/fire and discipline.
• Monitors, evaluates, inspects and investigates commercial activities including collecting evidence, preparing fact finding reports, directing or recommending corrective actions to parties involved, participating in enforcement actions and preparation of cases, assisting prosecutors and federal and state attorneys with evidence along with witness lists and providing testimony.
• Promotes awareness and acceptance of best management practices related to consumer protection and marketing laws, regulations and standards; provides training and information to consumers and businesses and responds to inquiries regarding program requirements and interpretation of laws and regulations.
• Assists Administrator in developing and reviewing policies and procedures and developing, implementing and maintaining the strategic plan.

Weights and Measures Administrator

The level is responsible for administering the Weights and Measures program and operations to ensure compliance with and enforcement of state, federal and national laws, rules, regulations, policies and procedures.

• Reports to the Deputy Secretary.
• Directs, coordinates and oversees section activities.
•  Formulates program policies and plans and monitors operations.
• Oversees and/or participates in the investigation of consumer complaints and violations identified during inspections.
• Oversees and participates in gathering, preserving and securing evidence and the preparation and prosecution of court cases.
•  May assist other enforcement agencies on investigations.
• Trains inspectors on courtroom procedures and testifies in court cases, as required.
• Keeps abreast of appropriate State and Federal laws and regulations.
•  Acts as liaison with federal and national weights and measures personnel to develop and implement appropriate activities and programs.
• Attends and participates in regional and national conferences.
• Recommends changes to State laws or rules and regulations.
• Oversees and participates in the development, preparation and presentation of educational and training programs for Weights and Measures staff and the public and private sectors.
• Plans, develops and administers the section budget.

The intent of the listed knowledge, skills and abilities is to give a general indication of the core requirements for all positions in the class series; therefore, the KSA's listed are not exhaustive or necessarily inclusive of the requirements of every position in the class.

• Knowledge of mathematics including statistical analysis.
• Knowledge of investigative methods and procedures.
• Knowledge of the methods and techniques of evidence collection, preservation and security.
• Knowledge of safe handling procedures for various hazardous materials, such as propane, gasoline and fuel oils.
• Skill in the operation and/or use of vehicles, tools and mechanical, electronic and technical equipment used in inspection and investigation activities.
• Ability to organize and schedule work.
• Ability to perform duties with minimal supervision.
• Ability to effectively deal with hostile situations.
• Ability to prepare and present criminal cases.
• Ability to understand, interpret, apply and explain applicable laws, rules, regulations, standards and procedures.
• Ability to determine appropriate action based on data collected or nature and extent of violations.
• Ability to develop and conduct educational programs for the public and private sectors.

In addition to the above knowledge, skills and abilities, the Weights and Measures Supervisor requires:

• Knowledge of supervisory methods and techniques.
• Skill in interpreting, applying and explaining applicable laws, rules, regulations and standards.
• Ability to calibrate Class F field standards.

In addition to the above knowledge, skills and abilities, the Weights and Measures Administrator requires:

• Knowledge of administration.
• Skill in repairing manual and automated test equipment.
• Skill in reviewing and analyzing data collected and generated during inspections.
• Ability to oversee investigations of violations and consumer complaints and the preparation and presentation of criminal cases.
• Ability to make effective presentations.
• Ability to prepare a budget.

JOB REQUIREMENTS for Weights and Measures Inspector I
Applicants must have education, training and/or experience demonstrating competence in each of the following areas:

1. Knowledge of inspecting, testing, weighing and measuring devices.
2. Knowledge of math such as addition, subtraction, multiplication, division, percentages, or decimals.
3. Knowledge of record keeping.
4. Knowledge of applying laws, rules, regulations, standards, policies and procedures.
5. Knowledge of using an automated information system to enter, update, modify, delete, retrieve/inquire and report on data.
6. Possession of a valid Driver's License (not suspended, revoked or cancelled, or disqualified from driving).
