Summary Statement

This position works within the Administrative Office of the Courts and serves at the pleasure of the State Court Administrator.

  1. Experience with labor and employment law.
  2. Experience in public sector bargaining.
  3. Ability to train management, HR personnel, and court staff attorneys on labor and employment laws.

Essential Functions

Working under the supervision of the Chief of Legal Services, this position will be responsible for:

  • Providing counsel and guidance to court management, court HR departments and court staff attorneys on issues of labor and employment law, including but not limited to, Title VII, ADA, ADEA, FMLA, FLSA, and other applicable state and federal laws.
  • Providing counsel and guidance to court management, court HR departments, and court staff attorneys on labor/union related law, including but not limited to, bargaining, contract interpretation, grievance/arbitration, and disciplinary matters pursuant to applicable CBAs and labor laws.
  • Reviewing and developing Judicial Branch employment rules, policies, and procedures to ensure compliance with state and federal law.
  • Training court management, court HR staff, and court staff attorneys on labor and employment laws and trends.
  • Lead internal investigations regarding employee relations matters and prepare written summaries and recommendations.
  • Represent the judicial branch in employment related hearings.
  • Any other job-related duties as assigned.

Job Requirements

Applicants must have education, training and/or experience demonstrating competence in each of the following areas:

  1. Graduation from an accredited law school/member in good standing of the Delaware State Bar.
  2. Minimum of five years of work experience as a labor and employment attorney.
  3. Excellent research and writing skills.
  4. Outstanding analytical and problem-solving skills.
  5. Excellent communication and interpersonal skills.
  6. Demonstrated ability to manage multiple projects simultaneously.
  7. Ability to work in an environment where priorities may change daily due to internal or external demands.
  8. A cover letter and resume. (A legal writing sample may be requested at a later date.)

Conditions of Hire
