Deputy Attorneys General, with critical support from criminal special investigators, victim service specialists, paraprofessionals, and administrative staff, prosecute criminal cases, enforce consumer laws, provide counsel to state agencies, ensure the public's access to open government, protect the abused, and much more.

Summary Statement

The Delaware Department of Justice, Civil Division, Departments and Agencies Unit seeks a Deputy Attorney General (“DAG”) to be assigned primarily to provide general counsel to the Delaware Department of Labor (“DOL”).  

This Deputy Attorney General represents the Division of Industrial Affairs, the Industrial Accident Board, the Division of Vocational Rehabilitation, the Office of Labor Market Information, the Office of Anti-Discrimination (DOL – EEOC), the Office of Workers Compensation, the Office of Construction Industry Enforcement (Wage & Hour/Child Labor/ Prevailing Wage/ Workplace Fraud/Contractor Registration), and the Office of Safety and Health Administration.  The position may also involve subpoena enforcement for the Division of Unemployment Insurance.

Pay Grade A18 DAG IV  Salary Range $106,626/min  $108,737/max 
Pay Grade A20 DAG V  Salary Range $118,238/min  $122,920/max 

Essential Functions

Principal Accountabilities include: providing general counsel, filing and presenting wage claim cases in both the Justice of the Peace Courts and the Court of Common Pleas; filing and presenting prevailing wage deficiency cases in the Superior Court; presenting on behalf of the DOL in administrative hearings before the Secretary of Labor on prevailing wage classification disputes, workplace fraud violations, and contractor registry violations; providing legal advice on FOIA issues, prevailing wage issues, wage reporting issues, confidentiality issues; performing contract review; and drafting legislation, administrative regulations and rules.  The DAG may be requested to assist DOL in other matters.

This DAG will handle additional assignments as directed by the State Solicitor, Deputy State Solicitor or Unit Head.  

Job Requirements

Candidates must possess excellent writing, research, statutory interpretation and litigation skills. Experience in prosecuting non-complex litigation before Delaware courts and experience in prosecuting cases before an administrative hearing officer is beneficial.  This DAG should be able to work independently and meet deadlines, with demonstrated legal ability and thorough knowledge of relevant laws and court rules.  Membership in Delaware Bar is required.
