Introduction
Delaware's Attorney General, the State's chief law enforcement officer, has a broad responsibility to combat crime, uphold civil rights, safeguard families, fight fraud, and protect consumers in the First State. In meeting this mission, Attorney General Kathy Jennings is supported by teams of talented lawyers and staff in the Criminal, Civil, Family, Fraud and Consumer Protection, and Civil Rights and Public Trust Divisions. Each of the more than 500 staff who work in the Office of the Attorney General are dedicated to serving all Delawareans with integrity and passion. Deputy Attorneys General, with critical support from criminal special investigators, victim service specialists, paraprofessionals, and administrative staff, prosecute criminal cases, enforce consumer laws, provide counsel to state agencies, ensure the public's access to open government, protect the abused, and much more.
Summary Statement
The Delaware Department of Justice is seeking a highly motivated Deputy Attorney General with a strong commitment to public service to fill a senior leadership role.
This is a significant and senior leadership opportunity within the Department of Justice (DOJ) that offers an opportunity to work closely with the DOJ front office and Division Head on major policy priorities for the Department of Justice that affect residents of the State of Delaware in many important areas.

Essential Functions
The Director serves as the lead attorney overseeing the Attorney General’s affirmative impact litigation work with outside counsel across a variety of subject matters in pursuit of policy priorities of the Attorney General. This currently includes the Attorney General’s climate deception litigation, opioid litigation, litigation over the contamination of Delaware’s natural resources by PCBs and PFAS, and litigation on behalf of the beneficiaries of the Alfred I. duPont Charitable Trust. The Director may also be tasked with pursuing other affirmative impact litigation work, and with overseeing investigations that could potentially lead to additional affirmative impact litigation work supporting the Attorney General’s policy priorities.
The Director is also responsible for overseeing the Attorney General’s participation in multistate federal litigation with other state attorneys general, whether as a plaintiff challenging federal rulemaking or participating as an intervenor in the federal government’s defense of federal rulemaking, such as those involving environmental clean air and clean water issues, immigration restrictions, civil rights matters, access to healthcare, and employee labor protections.
The Director oversees the Attorney General’s work on amicus briefs, rulemaking comments, and position letters on all non-criminal matters, working with a Deputy Attorney General and Paralegal to track, review, and research all incoming briefs, comments, and letters and prepare recommendations to the Attorney General whether to sign on to those briefs, comments, and letters. The Director also, as directed, takes a lead role in drafting amicus brief, comments, and letters to emphasize and implement the Attorney General’s policy priorities.
The Director serves as the lead attorney for the Attorney General’s charter revocation work, including coordination with the federal Office of Foreign Asset Control and the Delaware Division of Corporations.
The Director also serves as the Attorney General’s designee to state attorneys general working groups on voter and election protection, reproductive rights, and firearms regulation.
Administratively, the Director is responsible for all phases of management of the Office of Impact Litigation, including, currently, supervising one full-time Deputy Attorney General, one full-time paralegal, and one Deputy Attorney General working on a contract basis.
The Director may also advise on legislative initiatives of the Attorney General.
The Director reports to the Director of the Fraud and Consumer Protection Division and may perform other duties as assigned.
Job Requirements
Candidates must have very strong organizational skills, be able to work independently and meet deadlines, and have a strong understanding of all facets of complex civil litigation. The strongest candidates will also have significant management experience, at least ten years of complex litigation experience, strong writing and presentation skills, and at least basic familiarity with financial reporting and accounting. We seek an individual with a strong commitment to working in the public interest. Delaware Bar Admission or a willingness to sit for the next Delaware Bar exam is required.
