Main Purpose of Job

Under the direction of MHBE’s Chief Compliance/Chief Privacy Officer, the Privacy Compliance Analyst is responsible for assisting with implementation and maintenance of MHBE’s Privacy Compliance program. The Privacy Analyst will assist in the development and implementation of all facets of the Privacy Compliance Program, including, but not limited to privacy compliance training; auditing and monitoring activities; ensuring privacy plans, policies, procedures and internal controls  reflect current law, regulation and practice;  and, investigation of privacy compliance incidents. The Privacy Analyst may also lead special projects as assigned by the Chief Compliance/ Chief Privacy Officer. 

POSITION DUTIES

Assist in development and lead implementation of MHBE’s Privacy Program, incorporating corrective actions and new privacy requirements into annul Privacy Plan and Privacy Notice. 

Assist with the development, distribution, implementation and tracking of privacy forms, documents, policies and training materials.

Actively lead and coordinate privacy incident reporting, investigations, risk mitigation, breach analyses and breach notifications, and corrective action plans for internal and external stakeholders.  Document activities in the incident management system, track and report.

Prepare requested reports by collecting, analyzing and summarizing relevant information obtained through investigations, work plan submissions and other privacy compliance activities.

Collaborate with Compliance, IT Security and other designees to complete annual Privacy Impact Assessments, MARS-E v2.0 Privacy self-assessments, and independent external audits as mandated by Centers for Consumer Information and Insurance Oversight (CCIIO), Centers for Medicaid and Medicare Services (CMS), and Internal Revenue Service, respectively.  Assist and/or lead performance of other periodic information privacy risk assessments and audits for internal and external stakeholders.

Collaborate in the development, tracking and maintenance of all official records regarding due diligence and compliance for MHBE Non-Exchange Entities Agreements.

Perform annual and ongoing Personally Identifiable Information Inventory assessments, in collaboration with IT Security, to ensure PII inventory is complete and maintained so as to minimize access to, use of, and disclosure of consumer PII (inputs and outputs) to only that amount which is required for individuals to complete their job functions, within and across the Exchange. 

MINIMUM QUALIFICATIONS

Education: A Bachelor's degree from an accredited college or university.

2-5 years of verifiable experience in Privacy or Healthcare Compliance. One year of this experience must have involved one or more of the following: supervision, overseeing and coordinating the general operations of a unit, applying rules and regulations, or exercising responsibility for the development of policies or procedures.

Notes:

1. Candidates may substitute U.S. Armed Forces military service experience as a commissioned or non commissioned officer involving staff work related to the administration of rules, regulations, policy, procedures and processes, or overseeing or coordinating unit operations or functioning as a staff assistant to a higher ranking commissioned officer on a year-for-year basis for the required education and experience.

DESIRED OR PREFERRED QUALIFICATIONS

1. 2+ years of experience with data inventory documentation, privacy impact assessments, and data mapping

2. Practical experience leading Privacy programs or functions, Privacy regulations to include policy, procedure and data use agreement development, monitoring compliance with privacy practices, and incident management.

3. A Masters Degree in healthcare or business administration or JD.

4.Certification in Privacy or Healthcare Compliance. (CIPP, CIPM, CIPT and/or related certifications a plus).

LICENSES, REGISTRATIONS AND CERTIFICATIONS

Employees in this classification may be assigned duties which require the operation of a motor vehicle. Employees assigned such duties will be required to possess a motor vehicle operator's license valid in the State of Maryland.

This is a Management Service position, and serves at the pleasure of the Appointing Authority.
