Main Purpose of Job

This position serves as the adjudicator at inmate disciplinary hearings and involves applying Departmental policies and procedures as well as maintaining compliance with the Maryland Code of Administrative Regulations (COMAR). This position requires impartial “fact-finding” based on evidence presented during administrative inmate disciplinary hearings and requires that dispositions be entered based on the findings of fact. In the case of guilty or informal dispositions, this position requires sanctions be imposed that effect inmate sentences, program and security status, and privileges. All disciplinary hearings must be fully and accurately documented in the Department's official electronic databases and official records. Audio recordings must be maintained according to Departmental policies and procedures. All functions must be performed independently, fairly, and impartially while working under stressful and sometimes hazardous conditions.

POSITION DUTIES

  • Candidates in this classification must be willing to travel to correctional institutions in the State of MD
  • Reviews all related forms, documentation, witness testimony, and physical evidence presented by the institutional staff and inmates for hearings in order to ensure expedience, continuity of hearing procedures and time frames as outlined in the Departmental, Agency and Institutional directives.
  • Interprets Departmental, Agency and Institutional directives, and court mandates to determine procedures utilized in administrative hearings that are consistent with due process of law.
  • Conducts, documents, and records hearings in order to make "fact-finding" in accordance with court mandates and Departmental, Agency and Institutional directives.
  • Prepares summary of proceedings, evidence, fact-finding and conclusions in order to substantiate the decision rendered in accordance with due process of law and Departmental, Agency and Institutional directives.
  • Serves as resource to administrative and other staff in interpreting regulations and directives regarding administrative hearing procedures by responding to verbal and written inquiries.
  • Composes affidavits, acts as a resource and expert, and gives testimony regarding legal issues before federal and state courts.  Provides representation for Department in regards to issues and proceedings before Administrative Law Judges.
  • Ensure constitutional due process in accordance with federal and state mandates court decisions consistent with all applicable laws and rulings.

MINIMUM QUALIFICATIONS

Education:   A Bachelor’s degree from an accredited college or university in criminal justice, psychology, sociology or a related field.

Experience: One year of experience counseling or supervising adult inmates in a correctional setting involving inmate compliance with institutional rules and regulations or one year of experience conducting compliance investigations or evidential hearings in a correctional setting.

Note: Candidates may substitute completion of high school or high school equivalency certificate and additional experience counseling or supervising adult inmates in a correctional setting on a year-for-year basis for the required education.

All qualifying experience and education must be on your application to receive credit. 

 

DESIRED OR PREFERRED QUALIFICATIONS

  • 1 year experience as a facility representative or institutional hearing officer in the inmate discipline process
  • 1 year experience as a case manager managing an inmate segregation population

This position is limited to current permanent or contractual employees of the Department of Public Safety and Correctional Services only.

LICENSES, REGISTRATIONS AND CERTIFICATIONS

Employees in this classification may be assigned duties which require the operation of a motor vehicle. Employees assigned such duties will be required to possess a motor vehicle operator’s license valid in the State of Maryland.

SPECIAL REQUIREMENTS

Candidates in this classification will be subject to a background investigation per the Department of Public Safety and Corrections, Code of Maryland Regulations, 12.10.01.05, Background and Criminal History Investigations.
