Main Purpose of Job

The main purpose of this full time position will be to serve as Privacy Officer for the Department as mandated by Federal law under the Health Insurance Portability and Accountability Act of 1996 (HIPAA). The candidate must have obtained a Doctorate of Jurisprudence and be licensed to practice law in the State of Maryland. This position is designated by the MDH Secretary to serve as MDH Chief Privacy Officer and will oversee and coordinate a broad range of health information policy, procedures, and program activities in all MDH business units to comply with the mandate. This position is also responsible for providing legal interpretation, research and analysis on privacy issues and evaluating, analyzing, researching, and developing regulations and legislation for the department. The position performs a full range of duties to support policy, program and services development at the Office of the Inspector General (OIG), prepared reports summarizing the result of legal research, writes policies and testimony on health policy and health regulatory issues and communicates privacy policy to various department constituencies including the legislature.

MINIMUM QUALIFICATIONS

Education: A Bachelor's degree from an accredited college or university.

Experience: Five years of experience in administrative staff or professional work. One year of this experience must have involved one or more of the following: the supervision of other employees, overseeing and coordinating the general operations of a unit, applying rules and regulations, or exercising responsibility for the development of policies or procedures.

Notes:

1. Additional experience in administrative staff or professional work may be substituted on a year-for-year basis for the required education.

2. Additional graduate level education at an accredited college or university may be substituted at the rate of 30 semester credit hours on a year-for-year basis for the required general experience.

3. Candidates may substitute U.S. Armed Forces military service experience as a commissioned officer involving staff work related to the administration of rules, regulations, policy, procedures and processes, or overseeing or coordinating unit operations or functioning as a staff assistant to a higher ranking commissioned officer on a year-for-year basis for the required education and experience.

DESIRED OR PREFERRED QUALIFICATIONS

The desired candidate should have:
  • Knowledge of applicable federal and state privacy laws and accreditation standards, and monitor advancements in information privacy technologies. 
  • The ability to conduct various types of reviews and investigations ( e.g., HIPAA breaches, employee misconduct. procurement). 
  • The ability to develop written materials in order to effectively convey information about technical and/or complex Privacy and Corporate Compliance projects, activities, and functions.

LICENSES, REGISTRATIONS AND CERTIFICATIONS

Employees in this classification may be assigned duties which require the operation of a motor vehicle. Employees assigned such duties will be required to possess a motor vehicle operator's license valid in the State of Maryland.
