POSITION DUTIES

The primary purpose of this position is the supervisory level of professional work to procure equipment, services, and maintenance services and supplies needs for the Office of the Secretary, including procurement activities for other divisions per Code of Maryland Regulations, Title 21 State Procurement Regulations and the policies and procedures. Provide expert agency procurement technical interpretation, instruction, guidance and assistance in accordance with State laws and regulations. Supervise lower-level Procurement Officers

Solicit, evaluate, negotiate and award contracts for equipment, services, commodities, information technology, and other needs, as assigned by the Procurement Manager according to the State Procurement Laws, procedures and regulations to include:
• Reviewing and analyzing purchase requisitions and determining the most appropriate procurement method to use such as negotiated awards, competitive sealed bidding, competitive sealed proposals, preferred providers, state contracts, master contracts, sole source or emergency in accordance with State laws, procedures and regulations.
• Negotiates the most favorable prices, terms and conditions for noncompetitive sole source and emergency procurements.
• Analyzing and evaluating proposals, negotiating contract provisions and making award recommendations.
• Conducting Contractor debriefings.
• Ensuring all procurements are in compliance with Code of Maryland Regulations (COMAR) Title 21
• Conducting bid opening for competitive procurements to determine whether bidders are reasonably qualified to be selected for award.
• Researches materials and provides testimony regarding Board of Public Works contract approval;
• Ensuring all contracts assigned are re-bid/renewed prior to the expiration of the current contract to avoid retroactive or extensions to the contracts.
• Conferring with Assistant Attorney General’s office regarding bid irregularities, contract disputes, protests or appeals.
• Provides guidance to lower level procurement officers regarding interpretation of COMAR and departmental policies and procedures.
• Work closely with Director and/or Deputy Director to update agency procurement manual to ensure compliance with State regulations. Assist the Director and or Deputy Director with updating and recommending standard procedures to increase department efficiency. Trains and assists other procurement staff.

Administrative Duties (General):
• Ensures that requisitions assigned to appropriate procurement staff.
• Follow-ups on assignments and work load of procurement staff.
• Meeting the State’s Reporting Requirements on monthly, quarterly, and / or yearly basis.
• Serves on specialty teams that involve procurement.
• Responsible for initiating and implementing Department’s procurement process, procedures, and policies. Ensuring that they are consistently updated and in compliance with State’s regulations and laws.

Contract Administration Duties:
• Ensures contract compliance by both the vendor and the institutions are consistent with the terms and conditions of the contract, recommends corrective actions if either side is non-compliant to the contract.
• Determines and recommends corrective actions for poor contract performance and invoice deductions, including order cancellation or contract termination.
• Oversees and authorizes invoice payments.
• Evaluates contract performance and that deliverables are being met.
• Authorizes change orders and/ or modifications.
• Issuance of deficiency or cure notices.
• Planning, coordinating, evaluating, assigning and reviewing work of Procurement Managers and other lower level procurement staff.
• Maintaining personnel working file to monitor and authorize leave, as well as document performance for the PEP process.
• Approving time and leave requests.
• Advising of appropriate disciplinary actions
• Reviewing and approving lower level procurement staff work

MINIMUM QUALIFICATIONS

Education: A Bachelor’s degree from an accredited college or university.

Experience: Four years of professional public sector procurement, or private sector contracting experience, which included activities such as soliciting, evaluating, negotiating and awarding contracts, advertising procurement opportunities, distributing specifications to vendors, coordinating bidder evaluation committees, conducting vendor debriefings, monitoring contract performance, eProcurement management, professionals certification or procurement business operations.

Notes:

1. Candidates may substitute one year of experience in ensuring appropriate and consistent enterprise-wide interpretation of and compliance with enterprise level procurement laws, regulations, policies and procedures for the required education.

2. Candidates may substitute certification as a Certified Public Manager from the National Association of Purchasing Management; Certified Professional Contracts Manager from the National Contract Management Association; Certified Public Purchasing Officer or Certified Professional Public Buyer from the Universal Public Purchasing Certification Council (National Institute of Governmental Purchasing, Inc. or National Association of State Purchasing Officers) for the required education.

3. Candidates may substitute professional contract management experience or professional procurement experience, on a year-for-year basis, for the required education.

4. Candidates may substitute a Doctorate of Jurisprudence (JD) degree or a Master’s degree in Business Administration for two years of the required experience.

5. Candidates may substitute U.S. Armed Forces military service experience as a commissioned officer in Contracting, Industrial Management or logistics specialist classifications or administrative support specialty codes in the procurement or financial management fields of work on a year-for-year basis for the required experience and education.

DESIRED OR PREFERRED QUALIFICATIONS

Preference will be given to applicants who possess the following preferred qualification(s). Include clear and specific information on your application regarding your qualifications.

-Experience analyzing and evaluating proposals and procurements.

-Experience preparing contract proposals and biddings for contract negotiation conferences.

LICENSES, REGISTRATIONS AND CERTIFICATIONS

1.  Employees in this classification may be assigned duties which require the operation of a motor vehicle.  Employees assigned such duties will be required to possess a motor vehicle operator’s license valid in the State of Maryland.

2.  Employees in this classification who have not already done so must obtain certification as a Procurement Professional Certification from the Maryland Department of General Services within one year of appointment.
