Introduction

The Department of Labor, Board of Appeals is accepting applications from qualified candidates for the position of Program Manger IV with the function title as a Special Examiner. All candidates must meet the minimum and selective qualifications during the time apply. The resulting eligible list will be maintained for one year after the closing date of the announcement.

Main Purpose of Job

The Maryland Department of Labor ( LABOR )'s Board of appeals main purpose of this position will be to serve as a Special Examiner to the Board of Appeals. This position is essential to address the increased workload of the Board of Appeals brought on by the current recession.

POSITION DUTIES

 Review the case record of unemployment insurance cases on appeal to the Board and prepare draft decisions for the Board's signature.
 Summarize the contents of hearings as requested by the Board and advise the Board as to the adequacy of the evidence to support the Hearing Examiner's findings of fact and whether the conduct of the hearing comported with minimum requirements. 

 Screen appeals filed to the Board to determine whether they raise new questions of law, or whether the Hearing Examiner's decision is affected by new law, possibly volatile of Board precedent or inconsistent with any other decisions being issued by the Hearing Examiners or the Board of Appeals. Advise the Board in writing of these findings.
 
 Evaluate all allegations of procedural errors raised by appellants of Hearing Examiner's decisions, applying a knowledge of the Board regulations, the Hearing Examiner's legal jurisdiction, constitutional due process of law as it applies to administrative proceedings, United States Department of Labor hearing standards, and internal agency procedures and agency forms, to arrive at a written recommendation and a proposed decision for the Board which adequately addresses and disposes of the issues. 

 Special Examiner for the Board on occasion to hear difficult and complex cases including Labor Disputes and Employer Account cases, conduction hearing under oath and on the record in accordance with the Board regulations and drafting written decisions for the Board's signature. 

 Resolve questions as to what documents are properly a part of the record in each case appealed to the Circuit Court. 

 Assist with the updating of the precedent manual. 

MINIMUM QUALIFICATIONS

Education:   A Juris Doctor degree or equivalent degree from an accredited law school.

Experience: Five years of experience conducting unemployment insurance hearings and writing decisions on unemployment insurance

Notes:

1. These requirements are established by the Department of Labor, Licensing and Regulation by the authority provided in Title 8, Section 305 of the Labor and Employment Article of the Annotated Code of Maryland and the Office of Personnel Services and Benefits does not have authority to accept substitutions or equivalents.

2. Candidates may substitute U.S. Armed Forces military service experience as a commissioned officer in judge advocate classification or judge advocate specialty codes in the general attorney field of work on a year-for-year basis for the required education.

SELECTIVE QUALIFICATIONS

Admission to the Maryland Bar

Certificate of Good Standing from the Maryland Court of Appeals.

DESIRED OR PREFERRED QUALIFICATIONS

  • Knowledge of Maryland Unemployment Law and Administrative Law experience.  Proficient in Legal research and Legal writing. 

SPECIAL REQUIREMENTS

All candidates are subject to a background check against files maintained by the Division of Unemployment Insurance (DOL/DUI) to determine whether any monies are owed to DLLR/DUI as a result of an unemployment insurance overpayment and/or fraud. Any unpaid debt may have an impact on whether or not a candidate is offered employment.
