Introduction
The Maryland Insurance Administration (MIA) is an independent State agency that regulates Maryland’s insurance industry and protects consumers by monitoring and enforcing insurers’ and insurance professionals’ compliance with State law. Through the diligence of a highly professional staff of market analysts, financial analysts, accountants, lawyers, law enforcement officers, actuaries, complaint investigators, and others, the MIA works to facilitate a strong and competitive insurance marketplace where consumers are well informed and treated fairly. Staff members are subject matter experts who serve as a resource for lawmakers, consumers, and other public and private entities.
The MIA is
charged with a broad range of responsibilities including the licensure of
insurance carriers and insurance producers (brokers/agents) operating in
Maryland, the conduct of financial examinations of companies to monitor
financial solvency, and the review and approval of rates and contract
forms. The MIA investigates reports of consumer fraud and consumer
complaints about life, health, automobile, homeowners, and/or property
insurance. Insurance carriers are subject to market conduct examinations
and other actions to monitor compliance with Maryland law. The MIA also
has a unit dedicated to consumer education and outreach, which participates in
hundreds of events and reaches thousands of individual consumers
annually.

Main Purpose of Job
The Maryland Insurance Administration (MIA) is recruiting for the position of Associate Commissioner – Chief Hearing Officer. This position reports directly to the Associate Deputy Commissioner and serves as the lead Hearing Officer for the MIA’s Office of Hearings. As such, this position will function as the Commissioner’s primary designee under Md. Code Ann., Ins. § 2-210(d) for the conduct of quasi-judicial hearings and for the issuance of decisions on complaints stating causes of action under Md. Code Ann., Jud. Pro. § 3-1701 that are submitted to the Commissioner under Ins. § 27-1001. In addition, the Associate Commissioner – Chief Hearing officer presides over complex and significant cases and assists in the peer review of the work of other hearing officers and the administrative oversight and operation of the Office of Hearings.
POSITION DUTIES
This position will:
• Serve as a hearing officer for quasi-judicial administrative hearings, including conducting pre-hearing scheduling conferences, deciding motions, presiding over evidentiary hearings, and issuing Opinions and Final Orders on behalf of the Commissioner.
• Conduct on-the-record reviews of complaints stating a cause of action under Jud. Pro. § 3-1701 filed pursuant to Ins. § 27-1001.
• Participate in the management of the Office of Hearings, including participating in management decisions, oversight of personnel, and oversight of administrative operations, as assigned by the Associate Deputy Commissioner.
• Review case files related to hearing requests granted by the MIA to determine whether such cases shall be delegated to the Office of Administrative Hearings (OAH).
• Assign files retained for hearing at the MIA to Hearing Officers.
• Review and evaluate proposed decisions from the OAH and any exceptions filed by the parties, and determine whether to affirm or reverse, in full or in part, and issue Final Orders on behalf of the Commissioner.
• Participate in peer review and training.
• Assist the Commissioner with special projects.
MINIMUM QUALIFICATIONS
Education: Candidate
must hold a Juris Doctorate degree from an ABA accredited law school and must
be a member in good standing of the Maryland bar.
Experience: A minimum of ten (10) years of experience in the
litigation of insurance contractual and/or regulatory issues and two (2) years
of supervisory experience.
DESIRED OR PREFERRED QUALIFICATIONS

Knowledge
of Maryland insurance laws and regulations.

Knowledge
of Maryland decisional law related to insurance coverage and contractual
obligations.

Experience
in conducting or participating in evidentiary proceedings.
· Excellent written and verbal communication and organizational skills.
