Introduction
Alcohol, Tobacco, and Cannabis
Commission (ATCC) is tasked with supporting the Maryland Cannabis
Administration (MCA) in the regulation of the medical and retail cannabis
industries, as well as the regulation of the alcohol and tobacco industries, in
Maryland. The mission of the ATCC is to advance public safety, support economic
growth, and reduce public harm by promoting the responsible sale and
consumption of alcohol, tobacco, and cannabis products through consistent
administration and enforcement of laws and regulations, as well as the
strategic integration of process management, functional expertise, and the
study of operations and administration of similar laws in other states and
countries.
The mission of the Field
Enforcement Division of the ATCC is to protect consumers from illicit alcohol,
tobacco, and cannabis products entering the marketplace as well as ensuring
state revenues are protected. The Field Enforcement Division provides guidance
to the alcoholic beverage and tobacco industries through a program of
inspection, education, and enforcement to ensure compliance with state laws and
regulations. The Field Enforcement
Division strives to maximize a culture of compliance with the alcohol, tobacco
and cannabis laws and regulations of the state by being adaptable to statutory
changes and product evolution, employing modern technology, and advancing
state-wide consistency in enforcement.

Main Purpose of Job
Duties of this position will require the operation
of a motor vehicle. Employees assigned such duties will be required to possess
a motor vehicle operator’s license valid in the State of Maryland.
Duties of this position will require special
physical demands such as lifting 50 pounds or more, climbing
ladders, etc.
POSITION DUTIES
Investigations
● Receives and investigates complaints
related to potential violations of COMAR Trade Practice Regulation, Alcohol
Beverage Article, Tax General Article, and Business Regulation Article relative
to any commodity product regulated by the OED.
● Conducts interviews with members of
the commodity products industries (alcohol, tobacco, etc.) that are regulated
by the OED. Interviews potential
witnesses and suspects engaged in any suspected unlawful conduct. Receives formal written statements as
applicable.
● Performs covert surveillance of
establishments/entities that are engaged in the industries regulated by the
OED, and takes photographs as needed. Prepares detailed investigative reports
and completes accompanying documents as required in order to document
investigations.
● Testifies in criminal and/or civil
proceedings relative to investigations conducted that require formal
adjudication. (OED Administrative
Hearings, local Liquor Board Hearings, Maryland Criminal Courts)
Inspections
● Performs, coordinates, or assigns
unannounced, routine inspections of establishments that hold a license or
permit issued by the OED and conducts pre-license inspections relative to new
applicants that are seeking any license or permit issued by the OED; completes
the associated documentation of those inspections.
● Reports findings of routine
inspections. Makes recommendations to
the Trade Practice Unit Supervisor when additional investigation by, or in
conjunction with Field Enforcement Agents may be needed.
Industry
Outreach
● Works with industry members of those
commodity products (alcohol, tobacco, etc.) that are regulated by the OED to
seek voluntary compliance of applicable laws and regulations, relative to the
manufacture, distribution, sale, storage, and transportation of those regulated
commodity products.
● Provides education to industry
members in an effort to seek voluntary compliance of minor violations detected
during routine inspections. Provide
initial training and any necessary follow-up education to holders of a license
or permit issued by the OED.
● Attends and assists with discussions
among tobacco or alcohol beverage or other regulated commodities’ wholesalers,
importers, and associations to answer moderately complex questions regarding
State regulations and requirements. Resolves issues with industry employees on
the need and requirements for certain permits (solicitors and transportation
etc.).
MINIMUM QUALIFICATIONS
Qualified candidates must have the following qualifications.
Education: Graduation from an accredited high school or possession of a high school equivalency certificate.
Experience: Four (4) years of administrative staff or professional work.
Notes:
1. Candidates may substitute 30 college credit hours from an accredited college or university for each year up to four years of the required experience.
2. Candidates may substitute the possession of a Bachelor's degree from an accredited college or university for the required experience.
3. Candidates may substitute the possession of a Master's degree from an accredited college or university for the required experience.
4. Candidates may substitute U.S. Armed Forces military service experience as a commissioned officer involving staff work related to the administration of rules, regulations, policy, procedures and processes, or overseeing or coordinating unit operations or functioning as a staff assistant to a higher ranking commissioned officer on a year-for- year basis for the required experience.
DESIRED OR PREFERRED QUALIFICATIONS
The following are desired qualifications for this position.
- Prior work experience with a licensing or regulatory unit of a local, state or federal government agency.
- Three (3) years of work experience conducting criminal and/or administrative investigations, including the ability to prepare written narrative reports, conduct interviews of witnesses and suspects, the collection of evidence, providing testimony in criminal and/or civil proceedings, and the completion of other necessary documentation.
- Experience conducting inspections of a regulated industry that does business involving commodity products such as alcohol, tobacco, motor fuel, hazardous materials, food products, medicines etc.
- Experience providing training and/or conducting public speaking engagements.
- Experience within the alcohol and/or tobacco industry.
- Proficient with Microsoft Office applications and Microsoft Access database applications.
- Professional writing experience.
- College degree.
