LOCATION OF POSITION

Main Purpose of Job
The main purpose of this position is to serve as Secretary to the Commission, as defined under the Annotated Code of Maryland, Labor & Employment Article 9-305(b). This position serves under the direction of the Chair to perform each duty as assigned and keep at the principal office of the Commission, a public record of each proceeding including: each claim that the Commission considers; each document required to be submitted by the Commission or by a regulation of the Commission; each decision of the Commission; and each order passed by the Commission. This position also responds to every request for a record of the MD Workers' Compensation Commission as a Public Information Act request.
POSITION DUTIES
Custodian of Record
Performs a complex diversity of administrative tasks and duties to include; acquire and maintain a full and true record of all proceedings of the Commission, all documents and papers ordered filed by its rules and all decisions and orders issued by the Chairman and the Commissioners.
Provide safe custody and preservation of all records of the Commission, including all documents and papers ordered filed by its rules and all decisions and orders issued by the Chairman and Commissioners, in accordance with records disposition schedules approved by State Records Management Center and State Archivist.
Monitor agency general administrative procedures to ensure compliance with respect to record creation, maintenance, custody and control. Maintain a current inventory of all Commission forms.
Represent the Commission at various trials and hearings when various Commission records are subpoenaed.
Serve as the Records Management Officer for the Commission, directing staff to conduct periodic records inventories as required by State Regulations, the preparation of required records management reports, and monitoring the implementation and execution of appropriate records disposition schedules.
Conduct periodic record inspections of agency offices to ensure compliance with disposition schedules and record retention policies and procedures.
Coordinate as necessary with the Chair and the CEO in the development of appropriate policies, procedures, guidance, and directives to ensure that agency record-keeping complies with the applicable statutes and regulations.
Public Information Requests - EVERY request for a record of the MD Workers' Compensation Commission is a Public Information Act request.
The following list includes the basic responsibilities:
• Complete PIA training with the Office of the Attorney General.
• Respond with a “10-day letter” upon receipt of the request.
• Respond to all requests within the statutory required time frames (10 days, 30 days).
• When necessary, invoice and collect any fees associated with PIA requests.
• Work with Court Reporters when transcript requests are made under the PIA.
• Run a monthly report by the 10th of each month for new claims in the month prior to the just completed month.
• Review the claim list to determine “public employees” and redact those lines of information from the list.
• Post to website.
• Use the above list and modify for response to other specific entities as needed.
• Work with Public Service for responding to various entities looking for historical insurance information.
• Work with IT department for data requests that require specific or unique queries.
• Attend meetings of the PIA Commission and follow any proposed legislation by the PIA Commission and others.
Regulatory
Oversee and manage the regulatory process and work with the Principal Counsel in the promulgation of regulations. Keep the Chair, CEO, and agency staff abreast of any regulations that will impact the agency. Maintain legislative ABR system and track legislation impacting workers' compensation and keep the Chair and CEO apprised.
Miscellaneous
Direct the preparation & submission of ad-hoc repo1is required to be submitted on behalf of the agency as directed by the Chair of the Commission.
Responsible for managing the preparation and set-up of the hearing rooms for Open Meetings, Committee Meetings and Show Cause
MINIMUM QUALIFICATIONS
Education: Graduation from an accredited high school or possession of a high school equivalency certificate.
Experience: Five years of administrative staff or professional work.
Notes:
1. Candidates may substitute 30 credit hours from an accredited college or university for each year up to four years of the required experience.
2. Candidates may substitute the possession of a Bachelor's degree from an accredited college or university and one year of experience in administrative staff or professional work for the required experience.
3. Candidates may substitute the possession of a Master's degree from an accredited college or university for the required experience.
4. Candidates may substitute U.S. Armed Forces military service experience as a commissioned officer involving staff work related to the administration of rules, regulations, policy, procedures and processes, or overseeing or coordinating unit operations or functioning as a staff assistant to a higher ranking commissioned officer on a year-for- year basis for the required experience.
DESIRED OR PREFERRED QUALIFICATIONS
Experience with regulatory compliance and implementation.
Experience with program development and implementation.
Experience responding to PIA requests.
LICENSES, REGISTRATIONS AND CERTIFICATIONS
Employees in this classification may be assigned duties which require the operation of a motor vehicle. Employees assigned such duties will be required to possess a motor vehicle operator's license valid in the State of Maryland.
