POSITION DUTIES

The main purpose of this position is to serve as the Equal Employment Opportunity (EEO) Lead Investigator with the Office of Equal Opportunity. This position will be responsible for EEO complaints for assigned cases in the Department of Public Safety & Correctional Services (DPSCS). That includes investigating all complaints of discrimination, drafting investigative reports, providing findings with recommendations related to associated findings, engage in mediation, and participate in hearing/trial related to EEO investigation. Training on EEO, diversity and Diversity, Equity & Inclusion (DEI) topics, review, revise and delivery of EEO training, develop, deliver and oversight over assigned EEO/ (DEI) related programming, initiatives and operational enhancement. Assist with review of requests for reasonable accommodations in accordance with the Americans with Disabilities (ADA), ADA exemptions, oversee and provide Equal Opportunity (EO) training to staff and EO Designees, making recommendations relating to disciplinary measures based on investigation findings, determining Limited English Proficiency (LEP) needs, representing the Department at Office of Administrative Hearings (OAH), EEOC, Maryland Commission for Civil Rights (MCCR) and other court proceedings.

This position’s primary duty will be to investigate complaints of discrimination to include equal employment opportunity, Americans with Disabilities Act and sexual harassment complaints.  Receive, investigate, and recommend corrective action to charging parties’ supervisor via the Director and Deputy Director, participate in ADR and mediations, draft investigative report and associated documents related to Complaint file management, provide findings and recommendations related to EEO investigation,  and facilitate the resolution of all EEO/ADA related complaints filed by DPSCS employees, prepare detailed responses to EEO/ADA related complaints from outside agencies including the Equal Employment Opportunity Commission and the MD Commission on Civil Rights in their respective region.  The EEO Lead Investigator will be assigned the more complex complaints/inquiries, i.e. multiple allegations, multiple accusers, multiple complainants and be responsible for assisting with maintaining EEO Compliance, including mediation and resolution of Complaint.

Duties include: providing assistance and making recommendations to Director, Deputy Director, and/or Compliance Manager regarding policies, legislation, issues and operational functions related to EEO/ADA; reviewing and approving employment transactions; assisting in the development of policies and procedures regarding EEO/ADA; participating on interview panels to ensure fair hiring practices; reviewing statistical data of Department’s workforce and employment practices and monitor recruitment and retention progress; providing information and guidance to  managers regarding EEO/ADA laws and requirements for compliance. Drafting and providing any data associated with mandatory and optional EEO related and operational reporting.


Additional duties of this position include: keeping current new investigator training materials; facilitating, reviewing and modifying/updating EO Investigator training and EEO/DEI related training; assisting with training all new investigators and providing overall assistance to the OEEO Supervision regarding case management.  

This position will oversee and conduct EO Training in their respective area of DPSCS.  This position will support the Director,  Deputy Director, and EEO Compliance Manager of the Office of Equal Opportunity, by serving as the EEO Lead Investigator responsible for developing, delivering training and assisting with coordinating training in their region by directing, planning, developing, and implementing the training needs of the region with the EEO Compliance Manager. Trainings include all topics related to Equal Employment Opportunity, Compliance, Diversity Equity & Inclusion (DEI), Sexual Harassment, Unconscious/Implicit Bias and the American’s with Disabilities Act. 

MINIMUM QUALIFICATIONS

Education: Graduation from an accredited high school or possession of a high school equivalency certificate.

Experience: Six years of administrative staff or professional work.

Notes:

1. Candidates may substitute 30 college credit hours from an accredited college or university for each year up to four years of the required experience.

2. Candidates may substitute the possession of a Bachelor's degree from an accredited college or university and two years of experience in administrative staff or professional work for the required experience.

3. Candidates may substitute the possession of a Master's degree from an accredited college or university for the required experience.

4. Candidates may substitute U.S. Armed Forces military service experience as a commissioned officer involving staff work related to the administration of rules, regulations, policy, procedures and processes, or overseeing or coordinating unit operations or functioning as a staff assistant to a higher ranking commissioned officer on a year-for-year basis for the required experience.

DESIRED OR PREFERRED QUALIFICATIONS

Preference will be given to applicants who possess the following preferred qualification(s). Include clear and specific information on your application regarding your qualifications.

1. Experience assisting in caseload management of junior or new Investigators. 

2. Experience handling complex EEO matters, with multiple issues or parties, and a significant annual caseload of over 25 cases.

3. Experience conducting, delivering and formatting training related to EEO, Diversity, Equity, or  Inclusion.

4. Experience screening and assessing incoming internal investigative complaints.

5. Experience investigating complaints of discrimination to include equal employment opportunity, case management, drafting EEO related notice/investigative report, recommendations. referral of non- Equal Employment Opportunity matters, Americans with Disabilities Act and sexual harassment complaints.

LICENSES, REGISTRATIONS AND CERTIFICATIONS

Employees in this classification may be assigned duties which require the operation of a motor vehicle. Employees assigned such duties will be required to possess a motor vehicle operator's license valid in the State of Maryland.
