LOCATION OF POSITION
Main Purpose of Job
- Assists and leads compliance reviews, alongside the Executive Director/Fair Practices Officer, with technical assistance and other related activities is responsible for ensuring that MDH, and its components, as well as thousands of MDH licensed health care providers participating in one or more Federally assisted programs (i.e. Medical Assistance, Grants, etc.) comply with several Federal Civil Rights Regulations e.g., Title VI and VII of the Civil Rights Act of 1964, Title II (subtitle A) of the Americans with Disabilities Act., Sections 504 and 508 of the Rehabilitation Act of 1973, The Age Discrimination in Employment Act of 1975.
- Act as MDH’s Limited English Proficiency Program Coordinator, working with MDH managers and programs to assist them in establishing and maintaining procedures for providing services to individuals who are Limited English Proficient to ensure compliance with the Annotated Code of Maryland State Government Article § 10-1101 – 10-1104 and the U.S. Department of Health and Human Services- Office of Civil Rights Limited English Proficiency Guidelines.
- Assists the Executive Director/Fair Practices Officer with Section 1557 of the Patient Protection and Affordable Care Act ensuring compliance and addresses inquiries and grievances filed alleging failure on the behalf of MDH to provide assistive technology, meaningful language access and/or other types of discrimination occurred in the delivery of services by a health program.
- Assists the Executive Director/Fair Practices Officer with ADAAA reasonable accommodations, working with departmental personnel and managerial staff to ensure the Department’s compliance with the Americans with Disabilities Act and the State of Maryland’s Disability Law.
- Assists the Executive Director/Fair Practices Officer with HB1120 functions, a function established in 2020 and exclusive to the Maryland Department of Health, pursuant to Health General Articles §2-106 and §2-1001 – §2-1004. HB1120 ensures all MDH units provide affordable health care throughout the State to all regardless of race, color, religion, sex, age, national origin, marital status, sexual orientation, gender identity, or disability; and prohibit discrimination with respect to the provision of health care by any person, in order to protect and ensure the peace, health, safety, prosperity, and general welfare of all. The Secretary and/or a designee, OEOP Executive Director/Fair Practices Officer/HB1120 Coordinator, has exclusive jurisdiction to enforce by administrative action the laws of the State as provided for under this article and the Health Occupations Article.
- Assist in the investigation of claims of discrimination against any health care businesses and triage complaints against licensees for referral to MD State Boards and Commissions, Office of Healthcare Quality Maryland Commission on Civil Rights and/or US Department of Health and Human Services Office of Civil Rights, throughout the State of Maryland.
- Assists Executive Director/ADAAA Coordinator with COVID related reasonable accommodations at COVID testing and vaccination sites throughout the state of Maryland, as it relates to COVID activities and accommodations. Functions may include reviewing and approving/denying medical reasonable accommodation requests for vaccine exemption, for employees and applicants for employment, ensuring every testing and vaccination site is accessible and remains accessible.
- Reviews, interprets and provides significant input into the development of guidance for internal and external contacts, including but not limited to employees, partners, contractors, and the public.
- Acts as Respondent Representative to the state and federal agencies for request for information related to MDH’s response to the COVID pandemic and general equal access complaints of discrimination filed against the department.
- Serves as MDH’s Equal Employment Opportunity (EEO) Officer and assist the unit in the investigations of all EEO related complaints (discrimination, sexual harassment, fair practices…), as needed.
MINIMUM QUALIFICATIONS

- Knowledge of and experience with the following: Americans with Disabilities Act Amendment Act, Limited English Proficiency, Section 508 of the Rehabilitation Act, Section 1557 of the Affordable Care Act, HB 1120: Health Care Providers – Discrimination in Provision of Services
- Experience programming, reviewing, approving/denying medical reasonable accommodations
- Experience developing and maintaining COVID-19 related accommodation materials, processes, and procedures;
- Experience responding to complaints of disability discrimination
- Experience liaising with MDH Attorney General's Office, Office of Human Resources, Inspector General's Office, U.S. Department of Justice, Maryland Commission on Civil Rights, U.S. Equal Employment Opportunity Commission, U.S. Department of Health and Human Services-Office of Civil Rights, disability rights advocate groups, constituents and other internal and external entities.
