Main Purpose of Job

The main purpose of this position is to assist the Department of General Services (DGS) in meeting the requirements of the Maryland State Finance and Procurement Annotated Code Articles 14-201, 14-301, 14-501 and 14-601 and the Code of Maryland Regulations (COMAR) 21.11.01, 21.11.03 and 21.11.13, which includes all statutory, regulatory and policy requirements of the Small Business Reserve (SBR), Minority Business Enterprise (MBE) and Veteran-owned Small Business Enterprise (VSBE) programs.

This position has a key role in the agency’s mandatory reporting to the Governor’s Office of Small, Minority, and Woman Business Affairs (GOSBA) and the Board of Public Works (BPW). This position supervises the MBE/VSBE Compliance staff within the Office of the Procurement Policy, Compliance and Reporting (PPCR) Bureau. This position serves as the MBE, VSBE and SBR Liaison for DGS and provides expert advice on all MBE, VSBE and SBR support for both DGS OSP and Executive Branch Agencies under DGS OSP’s control and oversight, including overseeing the Procurement Review Group (PRG); provides mentoring and training of MBE/VSBE/SBR programs and best practices to the DGS staff and external parties, as needed; tracks all DGS contracts for compliance to all MBE/VSBE/SBR programs; and establishes and maintains supplier relationships by serving as a single point of contact for contractual matters.

POSITION DUTIES

Duties for this position include but are not limited to: 

- Assigns participation goal setting requests, forms, waiver requests and pre-bid/proposal conferences to the Compliance Unit staff to ensure goals are met, requests are in compliance and to make recommendations to Procurement Officers.

- Supervises the Compliance Unit staff in monitoring and tracking contracts for monthly compliance reporting. Maintains a working relationship with MBEs and VSBEs to ensure prime contractor is meeting contractual obligations and requirements with identified subcontractors. 

- Utilizes the State’s Advanced Purchasing and Inventory System (ADPICS) portion of the Financial Management Information System (FMIS) and eMaryland Marketplace Advantage (eMMA) to complete Blanket Purchase Order (BPO) entries and follow up with monthly data/payment entries to monitor achievements. 

- Assists with issues of MBE and VSBE non-compliance regarding State laws, regulations, policies, or procedures and provides guidance regarding required corrective actions. 

- Supervises the Compliance Unit staff in the training of Procurement Officers on reading and interpreting the overall content and information provided in required bid/proposal submissions to ensure State procurement statutes, regulations, policies, and procedures are met and to make proper determinations. 

- Advises Procurement Officers and Managers on questionable content to confirm documentation is acceptable and meets procurement requirements or if errors or omissions are curable. 

- Reviews waiver requests to confirm bidders/offerors made a good faith effort in trying to meet participation goals and advises Procurement Officers in making a determination. 

- Provides training regarding SBR, MBE and VSBE compliance programs to DGS OSP staff, Executive Branch Agencies [Senior Procurement Advisory Group (SPAG) meetings], and vendors. 

- Interfaces directly with senior leadership and other Executive Branch Agencies to provide expert advice on SBR, MBE and VSBE programs, policies and to report on the status of specific initiatives. 

- Reviews and provides compliance reports to GOSBA or to other State Agencies as required by legislation. Reviews and approves monthly and annual statistical reports to ensure accuracy and sufficiency of data; and makes recommendations for opportunities to enhance participation from prime contractors.

- Special Projects as assigned by the Director of the Procurement Policy, Compliance and Reporting Bureau or other DGS OSP Senior Management – Chief Procurement Officer (CPO) or Deputy CPO.

MINIMUM QUALIFICATIONS

Education:  Bachelor’s degree in Business Administration from an accredited college or university. 

Experience: Five or more years of experience with a Supplier Diversity Program (MBE/VSBE/SBR) that includes participation goal setting requests, compliance, reporting and outreach while partnering with a Procurement Office.  This experience must include at least three years of experience supervising resources for the program and updating the program as needed. Proficient with MS Office Applications such as Access, Word, Excel, and PowerPoint.

DESIRED OR PREFERRED QUALIFICATIONS

Preference will be given to applicants who possess the following preferred qualification(s). Include clear and specific information on your application regarding your qualifications. 

- Experience with the State of Maryland MBE, VSBE or SBR programs. 

- Research related experience such as data collection, analytical work, data analysis and trend identification to develop actionable information. 

- Experience designing instruction and delivering training classes to procurement professionals and vendors in a variety of settings. 

- Experience utilizing and applying COMAR Title 21, and the State Finance and Procurement Article of the Annotated Code of Maryland. 

- Knowledge and/or experience with eMaryland Marketplace Advantage (eMMA).

The examination for this position will consist of a rating of your education, training and experience related to the requirements of the position.  Successful candidates will be placed on the employment eligibility list categorized as BEST QUALIFIED, BETTER QUALIFIED, or QUALIFIED.  The eligibility list will be valid for one year and may be extended.  The list will be used by the hiring authority to select employees for interviews.  Eligible lists may be used to fill future vacancies of the same classification.

 

You MUST possess the minimum qualifications before you may be selected for a State job – verification will be completed upon hire.  If you are scheduled to complete an educational or licensing requirement within six months of being placed on the eligibility list, you may participate in the selection process.  Permanent State employees may also complete necessary experience requirements within six months of the date of being placed on an eligibility list.
