Introduction
Alcohol,
Tobacco, and Cannabis Commission (ATCC) is tasked regulating the alcohol and
tobacco industries and enforcing illegal alcohol and tobacco activities in
Maryland. The ATCC also supports the Maryland Cannabis Administration (MCA) and
the legal cannabis industry by conducting inspections and taking enforcement
actions when appropriate. The mission of the ATCC is to advance public safety,
support economic growth, and reduce public harm by promoting the responsible
sale and consumption of alcohol, tobacco, and cannabis products through
consistent and predictable administration and enforcement of laws and regulations,
as well as the strategic integration of process management, functional
expertise, and the study of operations and administration of similar laws in
other states and countries.
The mission of the Field Enforcement Division of the ATCC is to protect
consumers from illicit alcohol, tobacco, and cannabis products entering the
marketplace as well as ensuring state revenues are protected. The Field
Enforcement Division provides guidance to the alcoholic beverage and tobacco
industries through a program of inspection, education, and enforcement to
ensure compliance with state laws and regulations. The Field Enforcement Division strives to
maximize a culture of compliance with the alcohol, tobacco and cannabis laws
and regulations of the state by being adaptable to statutory changes and
product evolution, employing modern technology, and advancing state-wide
consistency in enforcement.

Main Purpose of Job
This is a managerial level of work as
a law enforcement agent executive for an agency enforcing and investigating
violations of the alcoholic beverage, tobacco products & cannabis / THC
products. Provide oversight, management,
and supervision of the Division's inspection programs designed to gain
voluntary compliance of the regulated industries (ie. Alcohol, Tobacco, Cannabis
& ESD). Function is to assure proper state licensure, protect revenue
sources and the public's health and wellbeing, and to maintain a fair and
balanced environment for Maryland business to compete in. The work of this
class involves managerial, supervisory, operational, and administrative
responsibilities for Enforcement Agent Leads, Enforcement Agents and civilian
employees. This position requires separate and distinct administrative and
supervisory responsibilities with equivalent level of authority and
necessitates the managerial designation as administrative or operational.
This is a Management Service position, and serves at the pleasure of the Appointing Authority.
POSITION DUTIES
Operational
Oversees the daily operations and
programs for the Field Operations Bureau, which would include the following
duties:

Plans long and
short-term investigations.
·
Reviews
investigative reports to determine merits of arrest and legal sufficiency for
prosecution in accordance with the applicable laws of the Maryland Annotated
Code and search and seizure.
·
Ensure that all
investigative reports are forwarded to the appropriate court or jurisdiction
for prosecution within the guidelines set forth in the Division's Procedures
manual.
·
Reviews Field
Intelligence Reports to identify individuals or groups in violation of tax laws
enforced by the Field Enforcement Division.
·
Maintain a
thorough knowledge base of Field Enforcement's operations and functions and a
detailed knowledge of operations, policies and procedures in the area of
cigarettes, alcohol, motor fuels, income tax and other tax investigations
conducted by the field staff.
·
Initiates
investigations involving all types of alcohol, tobacco and cannabis / THC
violations perpetrated against the state.
·
Plans, assigns
and supervises the work of others.
·
May be required
to participate on the Agency's Labor Management Committees for meeting with
AFSME and SLEOLA.
·
Interprets
program directives and policies and how they relate to the Agency and Division.
·
Must maintain a
comprehensive knowledge of current case law pertaining to Field Enforcement
cases and the ever-changing laws affecting search and seizure.
·
Understands all
procedures required to obtain and execute a search and seizure warrant, rules
of proper evidence handling and current laws relating to lawful arrest.
·
Monitor and
prepare necessary documents required for participation in the Federal Equitable
(Asset Forfeiture) Sharing Program.
·
Assist in the
preparation of the annual budget for the Field Enforcement Division, to include
the procurement of equipment, training and other expenses.
·
Authors and
reviews statistical documents for Division annual reports.
·
Prepares and
presents evidence at administrative hearings relating to violations committed
by wholesalers of alcohol, tobacco and cannabis /THC products, confiscations of
vehicles, tobacco products, alcoholic beverages and cannabis / THC products.
·
Develops plans to ensure enforcement of
alcohol, tobacco, cannabis / THC, applicable revenue laws and business license
regulations for the Field Enforcement Division.
·
Make
recommendations to the Deputy Director and or the Director regarding trends for
future enforcement operations.
·
Ensures that all
Employee Performance Evaluations (PEP) for subordinates and staff are completed
on or before dates due.
·
Appears before
various courts, administrative boards and liquor boards to successfully
prosecute violators or give expert testimony.
·
Review requests
for Administrative Hearings and schedule hearings if mandated. Be prepared to
act as prosecutor at these hearings, presenting evidence and securing testimony
from witnesses involved.
·
Conduct training
courses for staff members if required.
·
Supervise the
investigation of criminal or internal complaints which include verbal or
telephone threats made to employees of the Division or within the Agency.
·
If required,
attend and or testify before the General Assembly regarding bills that may
impact the Agency.
·
Testify before or
sit in on other professional boards that monitor the various laws the Agency
enforces.
·
Investigate
threatening correspondence or suspicious packages delivered to the agency or to
any employee of the Agency.
·
Evaluate and
analyze legislation and law changes (pertaining to the function of the
Division) and make recommendations to the Deputy Director or Director regarding
the proposed changes.
·
At the direction
of the Deputy Director or Director write directives or rules and regulations
for the Division personnel to follow.
·
If requested
write letters of commendation or appreciation for the Deputy Director of
Director.
·
Have a thorough
working knowledge of the State Law Enforcement Officers Labor Alliance (SLEOLA)
agreement/memorandum of understanding.
·
Have a thorough
working knowledge of the Law Enforcement officers Bill of Rights (LEOBR) and
how the law pertains filed agents assigned to the Division.
·
Have a thorough
working knowledge of the American Federation of State, County and Municipal
Employees (AFSCME) agreement/memorandum of understanding.
·
Inspect all
subordinates to ensure that they have valid Driver's Licenses.
·
The position may
be called upon, at any time, to conduct other duties or assignments not
specified in this document. These assignments could include staff, clerical or
administrative duties such as moving seized property, opening mail, answering
office phones, scanning documents or logging information in any of the various
data systems used by the Division.
·
Any other duties
so assigned to accomplish the mission of the Division.
Manages the activities of the
Supervisory staff, Agents and Investigators assigned to the Field Enforcement
Division which includes the following tasks: .
·
Conducts monthly
inspections of supervisor’s equipment, firearms and assigned vehicles to ensure
compliance with Division standards.
·
Meet daily with
supervisors to discuss personnel issues and assignments to ensure tasks are
carried out in accordance with the goals of the Division.
·
Oversees major
operations investigating violations regarding tobacco, alcohol and cannabis /
THC violations and other investigations as assigned. If required, insert self
in planning investigations with supervisory staff from conception to the
conclusion.
·
Conducts
oversight of time documents that details hours of work by supervisors and
agents to ensure they represent the actual hours worked and the use of overtime
and compensatory time is utilized properly.
·
Monitors
supervisors' and agents' daily activities to ensure all safety standards are
being complied with.
·
Monitors the
supervisors' and agents' activities so that any training deficiencies are
identified and corrected.
·
Prepare or write
new Rules and Regulations if compelled.
·
Prepare
comprehensive reports when necessary.
·
Provides guidance
and direction in the inspection of alcoholic beverages, cigarettes, other
tobacco products, tax records, state licenses, invoices, and other documents
for the purpose of detecting fraud and assessing compliance with State and
Federal laws and regulations.
·
Prepares
instructions, guidelines, checklists, and procedures for use by subordinates to
achieve desired uniformity of systems and interpretations of policy, rules and
regulations for the handling of day-to-day operations.
·
Employs a record-keeping
system that ensures all assigned investigations are completed in a timely
fashion within guidelines of the Division's rules and regulations.
·
Ensures
compliance with the Agency's Internal Controls objectives.
Oversees internal investigations for
the Field Enforcement Division and the Agency. Guides special investigations as
directed by the Director of the Field Enforcement Division or Executive
Director of the Agency.
·
Directs or
investigates internal complaints against police officers assigned to the
Division and recommends appropriate punishment when warranted.
·
Directs or
investigates internal investigations into formal complaints lodged against
civilian employees of the Field Enforcement Division; in accordance with
AFSMEIMOU, COMAR, state statutes and personnel regulations. Recommend
appropriate punishment when required.
·
Directs or
investigates Internal and/or background investigations for any unit of the
Agency when requested in accordance with state statutes and personnel
regulations. Coordinates and discusses enforcement activities with Federal,
State, and local law enforcement agencies involving the following tasks:
·
Maintains daily
contact with other agencies to obtain current information on tobacco smugglers,
alcohol violators and cannabis / THC violators operating within Maryland or to
identify violators traveling through Maryland.
·
Plans joint
operations with state and local agencies to combat tobacco smugglers &
violators, cannabis / THC smugglers & violators and alcohol violations and to
coordinate participation with Task Force Groups upon gaining approval from the
Director.
·
Coordinates with
various State's Attorney's Offices regarding proper prosecution of suspects
arrested by the Division.
·
Assists in the
training of personnel with other police agencies regarding the functions and
duties of the Field Enforcement Division.
·
Draft, review and
evaluate any Memorandums of Understanding that are generated to guide a working
relationship that is established with the Agency and other Federal, State or
local law enforcement agencies as a required step that precedes final approval by
the Director.
·
Make
recommendations on use of funds seized and forfeited to the Field Enforcement
Division by the Federal government.
·
Evaluates cases
to be forwarded to the Federal Equitable Sharing Program.
·
Completes all
paperwork, testifies at hearings, preserves needed federal documentation and
expense sheets pertaining to funds obtained by the Division from the Federal
Equitable Sharing Program.
·
Meets with and
educates the public and other government agencies about methods to combat tax
violations that relate to the Field Enforcement Division.
·
Handles sensitive
public contacts.
·
Completes PEP
evaluations for unit supervisors and staff assigned to your command and ensures
that the PEP evaluations are completed and submitted on or before the due date.
MINIMUM QUALIFICATIONS
Education: Graduation
from an accredited high school or possession of a high school equivalency
certificate as described in the Police
Training Commission regulation.
Experience: Six (6) years of experience as a police officer investigating
crimes including motor vehicle accidents and responding to emergency calls for
police services or as an enforcement agent (Certified police officer) responsible
for assessing and enforcing compliance with a framework of regulations and laws
imposed by the state on an industry; at least two (2) years of this experience
must have been at the supervisory level.
Notes:
1. The above education requirement is set by the Maryland Police Training
Commission in accordance with Public Safety Article, Section 3-
209, Annotated Code of Maryland.
2. Applicants may substitute additional education in criminal justice or
law enforcement, at an accredited college or university, at a rate of
30 credit hours for each six months of the required experience for a
maximum of three years of the required experience.
3. Candidates may substitute U.S. Armed Forces military service experience
as a non-commissioned officer in general inspection, investigation,
enforcement, and compliance classification or general inspection,
investigation, enforcement, and compliance specialty codes in the logistics
field of work on a year-for-year basis for the required experience.
SELECTIVE QUALIFICATIONS

LIMITATIONS ON SELECTION
This recruitment

LICENSES, REGISTRATIONS AND CERTIFICATIONS
1. Employees in this classification may be assigned duties which require
the operation of a motor vehicle. Employees assigned such duties will be
required to possess a motor vehicle operator’s license valid in the State of
Maryland.
2. After training, employees in this classification will
be required to maintain periodic certification of essential marksmanship in the
firing of a revolver and other firearms that may be necessary to carry out
assignments.
SPECIAL REQUIREMENTS
1. Selection standards for police officer certification are established by
the Police Training Commission in accordance with Public Safety Article,
Section 3-209 of the Annotated Code of Maryland. These selection criteria are
listed in detail in the Code of Maryland Regulations Title 12, Subtitle 04,
Chapter 01 and include the following:
Appointment as a police officer; U.S. Citizenship;
A complete background investigation; Oral interview;
Physical examination;
Possession of a driver’s license valid in the State of Maryland.
2. Employees in this classification must have successfully completed the
Entrance Level Police Training Course required by the Maryland Police Training
Commission and hold a current certification by the Maryland Police Training
Commission.
3. Employees in this classification are subject to call twenty-four hours a
day and must provide the agency with a telephone number where they can be
reached.
4. Employees in this classification are subject to substance abuse testing
in accordance with Code of Maryland Regulations 17.04.09, Testing for Illegal
Use of Drugs.
5. Two (2) years preceding promotion to the position or within one (1) year
following appointment to the position must successfully complete (70 percent
minimum overall test score) the First Line Administrator/Mid-Level Executive
Training Program approved by the Maryland Police Training Commission as required
by COMAR 12.04.01.13.
