Introduction

Maryland Department of Labor is currently accepting applications from qualified candidates for DLI Labor Enforcement Officer (Wage and Hour Investigator I) within the Division of Labor and Industry, Employment Standards, Prevailing Wage, Living Wage and Worker Classification and Protection Units.

Main Purpose of Job

At the entry level and under close supervision this position enforce and increase voluntary compliance with Maryland protective labor and employment laws which fall under the responsibility of the Department of Labor, Licensing, and Regulation.

This Wage and Hour Investigator I position is responsible for providing fluent bilingual translation and interpretation services to Spanish speaking customers on behalf of the Division of Labor and Industry.

POSITION DUTIES

Investigation: Under close supervision, conducts investigations and examinations by performing analysis and research to enhance labor law compliance in the state. Performs this function through the use of established investigative discovery methods and evidentiary analysis of payroll, personnel policies, contracts, time records and other required documentation. 

Provide bilingual translation and interpretation services to Spanish speaking customers on behalf of the Division of Labor and Industry. 

Evaluation: Evaluates and relates facts to compliance requirements, citing applicable labor laws and regulations, for the purpose of employee empowerment, preventing violations, and public education. Performs this function through direct telephone contact with program constituents, responsive letter writing, faxing requested documentary information, and in person communications. 

Adjudication: Adjudicates labor law violations after considering investigation results. Provides testimony during hearings regarding decisions. Enforces decisions by issuing citations, penalties, wage orders, final wage orders, subpoenas, and other notices. 

Outreach and Education: Provides consultation services to employers, employees, and other interested persons to improve labor law compliance in the state. Performs this function through written and oral communication, group presentations, and collaboration with employers to establish labor law compliance programs. 

Communication: Communicates fluent English to Spanish and vice versa with employers, employees, and other interested persons orally and in writing for the purposes of collecting unpaid obligations, issuing enforcement documents, addressing inquiries and providing conciliation services. 

Report Writing: Prepares narrative reports in fluent English and Spanish detailing investigations and follow-up activities. 

Other Duties as Assigned: Performs all other duties assigned. 

MINIMUM QUALIFICATIONS

Education: Graduation from an accredited high school or possession of a high school equivalency certificate.

Experience: Two years of general investigative work.

Notes:

1. Candidates may substitute the possession of an Associate’s or Bachelor’s degree from an accredited college or university for the required years of experience.

2. Candidates may substitute thirty (30) college credit hours from an accredited college or university for one year of the required experience not to exceed two (2) years of the required experience.

3. Candidates may substitute U.S. Armed Forces military service experience as a non-commissioned officer in the inspection, investigation, enforcement and compliance classifications inspection, investigation, enforcement and compliance specialty codes in the wage and hour investigation field of work on a year-for-year basis for the required experience.

DESIRED OR PREFERRED QUALIFICATIONS

Preference will be given to applicants who possess the following preferred qualification(s). Include clear and specific information on your application regarding your qualifications.

Experience in governing wages or employment practices in human resources or investigations or management, non-payment of wages, and/or pay equity.

Report writing and investigative background experience.

Ability to speak and write fluent Spanish.

Experience reviewing, researching, and applying standards and regulation in a codified environment.

LICENSES, REGISTRATIONS AND CERTIFICATIONS

Employees in this classification may be assigned duties which require the operation of a motor vehicle. Employees assigned such duties will be required to possess a motor vehicle operator's license valid in the State of Maryland.

SPECIAL REQUIREMENTS

Employees in this classification may be required to have daily use of a motor vehicle while on official State business. Standard mileage allowance will be paid for use of a privately owned vehicle.

All candidates are subject to a background check against files maintained by the Division of Unemployment Insurance (LABOR/DUI) to determine whether any monies are owed to LABOR/DUI as a result of unemployment overpayment/fraud. Any unpaid debt may have an impact on whether or not a candidate is offered employment.

Successful candidates will be placed on the certified list categorized as Best Qualified, Better Qualified, or Qualified. The certified list will be used by LABOR for a period of one year.
