POSITION DUTIES

The primary purpose of this position is the managerial level of professional work to procure information technology services and products, although this position may also entail managerial level of work over equipment, services, construction, supplies, and any other needs which must be obtained through the competitive procurement process, negotiated procurement process and other procurement methods within the Procurement Department of the Department of Public Safety and Correctional Services (“the Department” or “DPSCS”). Duties include managing day-to-day activities, soliciting, evaluating, negotiating, awarding and administering contracts, reviewing and analyzing purchase requisitions and determining the most appropriate procurement method to use, determining the basis of award and evaluation criteria, developing contract specifications, preparing Request for Proposals and Invitation for Bids, conducting pre-bid/pre-proposal conferences, and enforcing contract compliance with State programs (i.e., eMaryland Marketplace Advantage) and COMAR. This position works with the Deputy Director and the Executive Director of Procurement to ensure quality control and a sense of community is established within the Procurement Department. This position also manages a team of Procurement Officers and assists with assisting and training others to continue to make the Procurement Team at DPSCS a culture of inclusivity and learning.

Solicit, evaluate, negotiate and award contracts for equipment, services, commodities, information technology, and other needs, according to the State Procurement Laws, procedures and regulations to include: 

  • Reviewing and analyzing purchase requisitions and determining the most appropriate procurement method to use such as negotiated awards, competitive sealed bidding, competitive sealed proposals, preferred providers, state contracts, master contracts, sole source or emergency in accordance with State laws, procedures and regulations
  • Developing specifications and solicitations including small procurements, Request for Proposals (RFP), Invitation for Bids (IFB), determining the payment terms, contract management elements, contract modifications, contract renewals and advertisement requirements in accordance with State procurement procedures, laws and regulations for the procurement of all necessary services.
  • Conducting pre-bid/pre-proposal conferences, site inspections and participates in and/or conducts offerors discussions and contract negotiations.
  • Prepares minutes of pre-bid/pre-proposal conferences, addenda to Requests for Proposals (RFP)/Invitation for Bids (IFB)
  • Negotiates the most favorable prices, terms and conditions for noncompetitive sole source and emergency procurements
  • Analyzing and evaluating proposals, negotiating contract provisions and making award recommendations;
  • Conducting Oral Presentations
  • Conducting Contractor debriefings
  • Ensuring all procurements are in compliance with Code of Maryland Regulations (COMAR) Title 21
  • Conducting bid opening for competitive procurements to determine whether bidders are reasonably qualified to be selected for award
  • Examining bids to determine issues of responsiveness and responsibility and/or need for additional information
  • Processing and verifying Minority Business Enterprise (MBE) participation
  • Preparing documents for BPW contract approval
  • Researches materials and provides testimony regarding Board of Public Works contract approval
  • Ensuring all contracts assigned are re-bid/renewed prior to the expiration of the current contract to avoid retroactive or extensions to the contracts
  • Conferring with Assistant Attorney General’s office regarding bid irregularities, contract disputes, protests or appeals
  • Provides guidance to lower level procurement officers regarding interpretation of COMAR and departmental policies and procedures
  • Work closely with Director and/or Deputy Director to update agency procurement manual to ensure compliance with State regulations.
  • Assist the Director and or Deputy Director with updating and recommending standard procedures to increase department efficiency. 
  • Trains and assists other procurement staff.

MINIMUM QUALIFICATIONS

Education: Bachelor's degree from an accredited college or university.
  
Experience: 6 years of professional public sector procurement, or private sector contracting experience, which included activities such as soliciting, evaluating, negotiating and awarding contracts, advertising procurement opportunities, distributing specifications to vendors, coordinating bidder evaluation committees, conducting vendor debriefings, monitoring contract performance, eProcurement management, professional certification or procurement business operations, including at least two (2) years of supervisory or managerial experience. 

Notes:  

1. Candidates may substitute one year of experience in ensuring appropriate and consistent enterprise-wide interpretation of and compliance with enterprise level procurement laws, regulations, policies and procedures for the required education.  

2. Candidates may substitute certification as a Certified Public Manager from the National Association of Purchasing Management; Certified Professional Contracts Manager from the National Contract Management Association; Certified Public Purchasing Officer or Certified Professional Public Buyer from the Universal Public Purchasing Certification Council (National Institute of Governmental Purchasing, Inc. or National Association of State Purchasing Officers) for the required education.  

3. Candidates may substitute professional contract management experience or professional procurement experience, on a year-for-year basis, for the required education. 4. Candidates may substitute a Doctorate of Jurisprudence (JD) degree or a Master’s degree in Business Administration for two years of the required experience.

DESIRED OR PREFERRED QUALIFICATIONS

Preference will be given to applicants who possess the following preferred qualification(s). Include clear and specific information on your application regarding your qualifications.

  • Experience with COMAR Title 21 and other Maryland State procurement laws, regulations, policies, and procedures  
  • Experience with IT procurement 
  • Experience with FMIS

LICENSES, REGISTRATIONS AND CERTIFICATIONS

1.  Employees in this classification may be assigned duties which require the operation of a motor vehicle.  Employees assigned such duties will be required to possess a motor vehicle operator’s license valid in the State of Maryland.

2.  Employees in this classification who have not done so must obtain and possess certification as a Procurement Professional from the Maryland Department of General Services within one year of appointment.
