This is a Management Service position for the Deputy Director, Office of the Department Prosecutor, Maryland State Police and serves at the pleasure of the Appointing Authority.

Main Purpose of Job

The position functions as the Deputy Director of the Office of the Department Prosecutor, with the responsibility of assisting and supporting the Director, and assuming the role and responsibility of the Director of the Office of the Department Prosecutor in the Director's absence. The position is responsible for ensuring the effective and efficient management of the Department Prosecutor Section, which handles all civilian and sworn disciplinary matters, grievance matters, and represents the Department at proceedings before the Office of Administrative Hearings (OAH). This includes prosecuting disciplinary hearing boards; conducting plea negotiations; and serving as the Department's representative presenting emergency suspension matters. The unit will handle all civilian and sworn grievance matters and serve as the Department's representative for administrative hearings relating to issues arising through the Licensing Division and the Automotive Safety Enforcement Division (ASED).

POSITION DUTIES

Review and prepare sworn disciplinary cases for potential settlement or prosecution at trial board hearings. Prepare settlement agreements. Present the Department's case at trial board hearings.

Assist in overseeing the daily operations of the Office of the Department Prosecutor. The unit handles all civilian misconduct investigations and civilian and sworn disciplinary matters, civilian and sworn grievance matters, emergency suspensions, represents the Department at various proceedings before the office of Administrative Hearings, acts as a liaison to the Administrative Charging Committee, and litigates all trial board proceedings. Assume the role and responsibilities of the Director, as necessary.

Serves as an Appointing Authority and administers the delegation of authority process for civilian disciplinary actions. Oversees civilian investigations, recommends discipline as needed, and prepares cases for mitigation meetings and appeals.

Other duties as assigned by Command or the Director.

MINIMUM QUALIFICATIONS

Education: A Juris Doctorate (J.D.) from an accredited law school.

Experience: Applicant must have a minimum of three (3) years trial experience.

Note: Applicant must also be a member in good standing of the Maryland State Bar.

DESIRED OR PREFERRED QUALIFICATIONS

Preferred Qualifications:

1. Management and/or supervisory experience.

2. Experience working with/in Law Enforcement at the Local, County, State or Federal levels of government.

LICENSES, REGISTRATIONS AND CERTIFICATIONS

Employees in this classification may be assigned duties which require the operation of a motor vehicle. Employees assigned such duties will be required to possess a motor vehicle operator's license valid in the State of Maryland.

SPECIAL REQUIREMENTS

In accordance with Section 2-204 (b) (6) of the Public Safety Article, candidates for positions in this classification will be subject to an initial drug screening, a physical examination and a complete criminal background investigation, to include a polygraph examination, before permanent appointment can be made. A criminal conviction may be grounds for rejection of the candidate.

SELECTION PROCESS

The selection process for this recruitment will involve a review of each application. Applicants who meet the minimum qualifications will be placed on an eligible list in the BEST QUALIFIED, BETTER QUALIFIED or QUALIFIED category and remain eligible for consideration for at least one year from the date of examination. The list will be used by the hiring manager to select the individual to fill the vacancy.

EXAMINATION PROCESS

The examination will consist of a rating of your education, training and experience related to the requirements of the position. You may be required to complete a qualifications supplement, or the rating may be based on your application. Report all experience and education that is related to this position. Applicants may be given a physical examination and will be subject to an interview, background investigation, polygraph examination and substance abuse testing.
