Introduction


The Maryland Department of Agriculture is a department under Maryland's Executive Branch.  Formed in 1972 by the Maryland General Assembly to address the agriculture needs for the State of Maryland, the Department oversees and serves as a regulatory body for animal health, consumer services to include marketing and lab services, plant and pest management and resource conservation.  As the number one industry in Maryland, the diversity of agriculture programs in the State continues to expand and grow.

The Office of Central Services is dedicated to successfully providing goods and services to MDA’s internal and external customers. The Central Services team administers centralized support services for MDA, including, facilities operation and management, contract administration and procurement, fleet management, administrative services and small, local and the minority business development.

Main Purpose of Job

The primary purpose of this position is the supervisory level of professional work to procure equipment, services, maintenance services and supplies needed for the Maryland Department of Agriculture, according to the Annotated Code of Maryland and the Code of Maryland Regulations, Title 21 State Procurement Regulations and the State’s policies and procedures. The position provides expert agency procurement technical interpretation, instruction, training, guidance and assistance in accordance with State laws and regulations. The incumbent supervises lower-level Procurement Officers and paraprofessional support staff.

POSITION DUTIES

Supervise and direct the purchasing of procurements for goods and services:
  1. Planning, coordinating, evaluating, assigning and reviewing work of lower-level staff 
  2. Performing PEPS for lower level procurement staff in a timely manner. 
  3. Providing guidance and training to lower-level procurement and paraprofessional support staff
  4. Providing guidance to all other staff involved in the procurement process within the Department 
Provides expert level use and oversight of FMIS, from origination through the full level of approval. Reviews and approved purchase orders created in FMIS by lower level procurement and agency staff, ensuring accuracy, appropriateness, proper coding and availability of funding. Provides training and expert advice to other employees throughout the agency regarding FMIS. 

Oversees the management of the Department’s inventory database and processes ensuring compliance with all Department of General Services (DGS) Rules and regulations regarding the proper recording, maintenance and disposal procedures. 

Solicit, evaluate, negotiate and award contracts for maintenance, services, commodities, information technology, and other needs, as according to the State Procurement Laws, procedures and regulations to include: 
  1. Reviewing and analyzing purchase requisitions and determining the most appropriate procurement method to use in accordance with State laws, procedures and regulations; 
  2. Develops  contract  specifications including  performance, acceptance standards in determining the basis for awards and evaluation criteria in accordance with State procurement procedures, laws and regulations for the procurement of all necessary services, supplies, equipment, indefinite quantity contracts, facilities maintenance, and commodities  
  3. Conducts  pre-bid/pre-proposal conferences, site inspections, explains procurement requirements,  establishes procurement procedures, and schedules.
  4. Manages  the  advertisement of procurement  opportunities, distributes specifications to vendors, conducts vendor conferences, receives and secures bid or proposals, oversees the evaluation process and contract award and ensure all procurements are in compliance with Code of Maryland Regulations (COMAR) Title 21.
  5. Processing and verifying Minority Business Enterprise (MBE) participation, implements  new  and  revised  fiscal  policies, procedures and standards to capture complex procurement costs and prepares minutes of pre-bid/pre-proposal conferences, addenda to Requests for Proposals (RFP)/Invitation for Bids (IFB) and answers written questions from potential bidders and offerors. 
  6. Confers with the Office of the Attorney General regarding bid irregularities, contract disputes, protests or appeals and Public Information Act.
In coordination with the Director of Central Services, proactively tracks and manages contracts for the Department. Proactively monitors milestones and termination dates. Evaluates a contractor’s performance against the terms and conditions of the contract, recommends corrective actions, such as the application of damages, withholding of payment or termination of contract.

Attends scheduled Senior Procurement Advisory Group (SPAG), Minority Business Enterprise (MBE), Veteran Owned Small Business Enterprise (VSBE) and Small Business Reserve (SBR) meetings representing the Department. Serves as the MBE and SBE liaison. Supervises the processing of MBE and SBR reports and serves as the backup.

MINIMUM QUALIFICATIONS

                                                      Procurement Officer III- Option 1

Experience: Eight years of experience, four years of experience in ensuring appropriate and consistent enterprise-wide interpretation of and compliance with enterprise level procurement laws, regulations, policies and procedures and an additional four years of professional public sector procurement, or private sector contracting experience, which included activities such as soliciting, evaluating, negotiating and awarding contracts, advertising procurement opportunities, distributing specifications to vendors, coordinating bidder evaluation committees, conducting vendor debriefings, monitoring contract performance, eProcurement management, professionals certification or procurement business operations.

                                                       Procurement Officer III- Option 2

Experience: Seven years of experience, three years of experience in ensuring appropriate and consistent enterprise-wide interpretation of and compliance with enterprise level procurement laws, regulations, policies and procedures and an additional four years of professional public sector procurement, or private sector contracting experience, which included activities such as soliciting, evaluating, negotiating and awarding contracts, advertising procurement opportunities, distributing specifications to vendors, coordinating bidder evaluation committees, conducting vendor debriefings, monitoring contract performance, eProcurement management, professionals certification or procurement business operations.

Notes:

1. Candidates may substitute one year of experience in ensuring appropriate and consistent enterprise-wide interpretation of and compliance with enterprise level procurement laws, regulations, policies and procedures for the additional four years of the required experience.

2. Candidates may substitute certification as a Certified Public Manager from the National Association of Purchasing Management; Certified Professional Contracts Manager from the National Contract Management Association; Certified Public Purchasing Officer or Certified Professional Public Buyer from the Universal Public Purchasing Certification Council (National Institute of Governmental Purchasing, Inc. or National Association of State Purchasing Officers) for the additional four years of the required experience.

3. Candidates for Option 1 positions may substitute the possession of a Bachelor’s degree from an accredited college or university and four years of experience in ensuring appropriate and consistent enterprise-wide interpretation of and compliance with enterprise level procurement laws, regulations, policies and procedures for the required experience of experience.

4. Candidates for Option 2 positions may substitute the possession of a Bachelor’s degree from an accredited college or university and three years of experience in ensuring appropriate and consistent enterprise-wide interpretation of and compliance with enterprise level procurement laws, regulations, policies and procedures for the required experience.

5. Candidates may substitute the possession of a Doctorate of Jurisprudence degree or a Master’s degree in Business Administration for six years of the required experience.

6. Candidates may substitute U.S. Armed Forces military service experience as a commissioned officer in Contracting, Industrial Management or logistics specialist classifications or administrative support specialty codes in the procurement or financial management fields of work on a year-for-year basis for the required experience.

DESIRED OR PREFERRED QUALIFICATIONS

Preference will be given to applicants who possess the following preferred qualification(s). Include clear and specific information on your application regarding your qualifications.

Experience with COMAR Title 21 and other Maryland State procurement laws, regulations, policies, and procedures.

Experience with FMIS/ADPICS and eMaryland Marketplace Advantage (eMMA). 

Experience soliciting and managing contracts for various categories of goods and services. 

Experience ensuring appropriate interpretation of a compliance with procurement laws, regulations, policies, and procedures. 

Four (4) years of procurement management experience with public sector procurement, or private sector contracting. 

Current Certified Procurement Professional certification from the Maryland Department of General Services or any other certification that is related to Procurement.

LICENSES, REGISTRATIONS AND CERTIFICATIONS

1.  Employees in this classification may be assigned duties which require the operation of a motor vehicle.  Employees assigned such duties will be required to possess a motor vehicle operator’s license valid in the State of Maryland.

2.  Employees in this classification who have not already done so must obtain certification as a Procurement Professional Certification from the Maryland Department of General Services within one year of appointment.
