Main Purpose of Job

The Enforcement Analyst II position reviews and monitors compliance matters (related to settlement agreements, orders and other legal documents) provides operational support to the Enforcement Unit in carrying out the policies and procedures in examining/investigating individuals, unlicensed business entities, Maryland Chartered Banks, credit unions, trust companies, and licensed financial institutions to uncover improper business practices and/or violations of law subject to the jurisdiction of the Commissioner of Financial Regulation. The Enforcement Analyst II, in part, coordinates the transfer of investigations to financial fraud examiners and completed investigations to the Attorney General’s Office for enforcement action, composes letters and draft motions, complaints, certificates of service, and other pleadings as needed; reviews cases and responds to outside attorney request for evidence; and performs all aspects of data entry in the Case Management System for enforcement activity. Additionally, the Enforcement Analyst is responsible for ensuring that all charging documents (Cease & Desist Orders, Charge Letters, Final Order’s, Proposed Orders, Affidavits, Hearing Subpoenas, etc.) are mailed (first class and certified return-receipt requested) to all respondents, and acts as the Agency’s Hearing Administrator responsible for coordinating and/or scheduling all hearings relative to charges brought, issuing hearing subpoenas, and coordinating the transcription of hearing if needed. This position also functions as a Records Custodian for the Agency and coordinates the review and response to all Maryland public information requests as well as Subpoenas issued to the Agency. The Enforcement Analyst is an administrative position that may, in management’s discretion, work remotely in accordance with the Agency’s telework policies.

POSITION DUTIES

Duties of this position include but are not limited to:
  • Assists in maintaining the enforcement Case Management System, including updating information and ensuring that all information is current. 
  • Coordinates the transfer of investigations to financial fraud examiners and referrals of completed investigations to the Office of the Attorney General (“OAG”) for enforcement action. 
  • Assists in the research and preparation of cases for litigation. 
  • Processes charging documents (Summary Orders to Cease and Desist, Summary Suspensions, Charge Letters, et.) and ensures proper service to respondents via First Class U.S. and certified mail. Prepares Affidavits of Service. Receives requests for hearings and ensures that appropriate staff are notified of any requests for hearing received.

MINIMUM QUALIFICATIONS

Education:   Graduation from an accredited high school or possession of a high school equivalency certificate.

Experience: Two years of administrative staff or professional work.

Notes:

1. Candidates may substitute 30 credit hours from an accredited college or university for one year of the required experience.

2. Candidates may substitute the possession of a Bachelor's degree from a college or university for the required experience.

3. Candidates may substitute U.S. Armed Forces military service experience as a commissioned officer involving staff work that included regular use of independent judgment and analysis in applying and interpreting complex administrative plans, policies, rules or regulations or analysis of operational programs or procedures with recommendations for improvement on a year-for-year basis for the required experience.

DESIRED OR PREFERRED QUALIFICATIONS

Paralegal experience or administrative professional work in a legal, government or financial services organization

Experience handling Public Information Requests

Associates/Bachelor’s degree in Paralegal Studies, Law, Public Policy, Finance, Business or a related field.

LICENSES, REGISTRATIONS AND CERTIFICATIONS

Employees in this classification may be assigned duties which require the operation of a motor vehicle. Employees assigned such duties will be required to possess a motor vehicle operator’s license valid in the State of Maryland.

SPECIAL REQUIREMENTS

All candidates are subject to a background check against files maintained by the Division of Unemployment Insurance (LABOR/DUI) to determine whether any monies are owed to LABOR/DUI as a result of unemployment overpayment/fraud. Any unpaid debt may have an impact on whether or not a candidate is offered employment.
