Introduction

The Office of the Inspector General for Health (“Office”) was created by legislation in 2021 as an independent unit of the State, rather than a unit in the Maryland Department of Health (“MDH”). MDH is one of the largest agencies in state government, encompassing Medicaid, public health, developmental disabilities and behavioral health programs and providers, health occupations, , local health departments and  state facilities. The Inspector General for Health is responsible for independent audits, investigations, law enforcement, program integrity efforts, corporate compliance, ethics, and institutional review board efforts relating to the MDH programs and operations. The mission of the Office of the Inspector General is to “promote integrity and accountability within the Maryland Department of Health; to deter, detect and investigate fraud, waste, abuse and employee misconduct; and to disseminate actionable and meaningful recommendations with the goal of protecting the interests of the State and its resources.” 

Program Integrity Division
The Office of the Inspector General for Health’s Program Integrity Unit audits and investigates health care providers and suppliers of durable medical equipment and supplies who are suspected of overbilling or defrauding the Maryland Medicaid program. Findings of fraud and abuse may result in administrative actions or referral to the Office of the Attorney General, Medicaid Fraud Control Unit for civil or criminal prosecution.

The Program Integrity Unit also conducts investigations into allegations related to Medicaid consumer eligibility and misuse of benefit cards. In addition to seeking recovery of funds from Medicaid recipients who improperly received Medicaid services, the Unit coordinates with other State and federal law enforcement agencies to ensure streamlined investigations and prosecutions.

Audit Division
Medicaid Internal Audits performs periodic examinations and follow-up reviews of the accounts, records, procedures, and policies of the State’s Medicaid Program. The Division helps to prepare MDH units for legislative and federal audits by ensuring that MDH administrations have implemented corrective actions sufficient to resolve previously cited audit findings and reviews problem areas to prevent future audit deficiencies.

MDH External Audits conducts audits of human services vendors and local health departments receiving funding from the Department to ensure State funds are expended and reported in accordance with contract provisions, laws, regulations, and generally accepted accounting principles. The audits determine over or underpayments.

Fraud Reporting 
The Office of the Inspector General for Health manages a hotline and online reporting system to receive information related to fraud, waste or abuse in the administration of the Medicaid Program, the misappropriation of departmental funds and/or employee misconduct. The Office evaluates these concerns and takes appropriate action.

LOCATION OF POSITION

Maryland Department of Health at 201 W. Preston Street, Baltimore, MD 21201-2399. 
By statute, the Office is required to maintain a physical location within the Department of Health. 

Main Purpose of Job

The mission of the Office of the Inspector General for Health is to promote integrity and accountability within the Maryland Department of Health; to deter, detect and investigate fraud, waste, abuse and employee misconduct; and to disseminate actionable and meaningful recommendations with the goal of protecting the interests of the State and its resources. More specifically, the Office: 
• Performs audits of MDH programs and health care providers receiving Departmental funds; 
• Investigates and audits Medicaid providers and recipients to ensure the integrity of the Medicaid Program; and, 
• Ensures compliance with federal regulations and recommendations regarding integrity and ethics within MDH programs.

The Inspector General for Health manages a professional staff that includes attorneys, auditors, investigators, compliance officers, data analysts, and career administrators dedicated to promoting efficiency, effectiveness and compliance in MDH programs and pursuing fraud, waste and abuse that may occur on all programmatic levels. In FY2025, the Office had 41 authorized permanent positions and 6.5 contractual positions.

In October 2006, the Office of Inspector General was authorized by the General Assembly within the Department of Health and Mental Hygiene (now Maryland Department of Health) (Chapter 70, Acts of 2006). Effective July 1, 2022, the Office was renamed the Maryland Office of the Inspector General for Health, and made an independent agency of State government by the General Assembly (Chapter 325, Acts of 2021; Code Health-General Article, secs. 2-501 through 2-506).

With Senate advice and consent, the Inspector General for Health is appointed unanimously to a five-year term by the Governor, the Attorney General, and the State Treasurer. The term of appointment is five years, beginning on July 1 following the appointment, with eligibility for continuation until a successor is appointed.

POSITION DUTIES

PRIMARY RESPONSIBILITIES:
The Inspector General will:
• Oversee investigations of fraud, waste, and abuse within the Maryland Department of Health.
• Ensure compliance with state and federal regulations through proactive monitoring and policy development.
• Maintain the Office’s physical location and develop policies to safeguard its confidentiality.
• Collaborate with internal and external stakeholders to implement corrective measures and strengthen program integrity.
• Submit annual reports summarizing the Office’s activities, including recoveries of funds and referrals to prosecutorial authorities.
• Provide recommendations for regulatory or statutory changes to ensure compliance with applicable laws.

MINIMUM QUALIFICATIONS

Education: A Bachelor’s degree from an accredited college or university (advanced degree preferred).
To be eligible for the position of Inspector General, candidates must meet the following minimum qualifications as established by Maryland law:

Professional Qualifications: 
Must possess substantial experience or education in at least one of the following areas:
• Law
• Auditing
• Government Operations
• Financial Management
• Health Policy (with additional expertise in at least one other area listed above)

Affidavit Requirement: 
Must execute an affidavit affirming that they will:
• Not accept appointment to, or be a candidate for, any state or local office during their service as Inspector General.
• Refrain from seeking public office for at least three years after completing their term as Inspector General.
• The affidavit must be renewed every two years during the term of service. Failure to renew the affidavit may result in removal from office.

Appointment and Term Eligibility:
o Must be able to secure unanimous appointment by the Governor, Attorney General, and State Treasurer, subject to the advice and consent of the Senate.
o Must meet the eligibility criteria for serving a five-year term and continuing service until a successor is appointed.

DESIRED OR PREFERRED QUALIFICATIONS

The ideal candidate for the Inspector General position will possess:

Extensive Leadership Experience: Proven ability to lead independent investigative units or compliance offices in a government, health policy, legal, or auditing setting.

Strong Educational and Professional Background:
o Advanced qualifications in law, auditing, government operations, financial management, or health policy, with combined expertise in multiple areas being highly desirable.
o Demonstrated expertise in developing and implementing regulatory or compliance frameworks.
o Knowledge of state and federal laws governing public health programs and Medicaid

Exceptional Analytical and Problem-Solving Skills:
o A track record of identifying and addressing complex issues related to fraud, waste, and abuse in public programs.
o Experience conducting high-level investigations, audits, and risk assessments.

Commitment to Ethical Standards and Integrity:
o A demonstrated commitment to transparency, accountability, and adherence to state and federal laws.
o The ability to execute and renew the legally required affidavit affirming non-candidacy for public office during and after the term of service.

Collaborative and Strategic Leadership Abilities:
o Experience working across multiple agencies or units to foster collaboration and implement effective solutions.
o Strong skills in communicating findings and recommendations to high-level stakeholders, including legislators, agency leaders, and the public.
o Proven experience in leading teams and managing complex investigations or compliance programs.

Effective Policy and Regulation Development Skills:
o A deep understanding of health-related programs and regulatory requirements.
o Proven ability to draft, adopt, and enforce policies to safeguard program integrity and improve operational efficiency.
o Extensive experience in auditing, investigations, program management, or law enforcement, preferably in health-related fields.
