DEFINITION

Under direction, performs supervisory legal work over a major function of the District Attorney's Office; participates in the professional legal work of the Office; and does related or other work.

CLASS CHARACTERISTICS

An incumbent of this exempt class is responsible for planning, organizing and supervising the work of subordinate attorneys assigned to a major functional unit within the Legal Division of the District Attorney's Office.

TYPICAL DUTIES

  • Plans, organizes, and supervises the preparation and prosecution of criminal and some civil matters before Municipal or Superior Court; assigns cases to subordinate attorneys; advises subordinates on effective prosecution of cases.
  • Evaluates performance of subordinate attorneys; participates in training subordinates.
  • Participates in prosecution of important and/or complex cases; prepares and reviews briefs, memoranda, opinions and civil and criminal pleadings.
  • Researches, analyzes and interprets existing laws and ordinances, court decisions, pending legislation and other legal authorities; assists in drafting legislation for special County and State projects.
  • Confers with defense attorney's probation authorities, court officials and law enforcement agencies to discuss pleas, modification of charges, presentation and review of evidence and other legal matters.
  • Advises the general public, State and local departments and law enforcement officers on civil and criminal issues and proceedings; advises and directs law enforcement agencies on questions of law in criminal investigation matters.
  • Prepares correspondence and reports.
  • Recommends policy and procedural changes to improve staff effectiveness.

MINIMUM QUALIFICATIONS

Membership in the California State Bar.

Experience: Four years of experience in the practice of criminal law, at least one year of which was in a state, city or county legal office.

KNOWLEDGE

Principles and practices of management, supervision and training; principles of criminal and civil law and their application; trial and hearing procedures; rules of evidence; state and local laws and ordinances; legal research methods; preparation of briefs and opinions. 

ABILITY

Plan and organize the work of others; analyze legal principles and precedents and to apply them to complex factual legal problems; present statements of fact, law and argument clearly and logically in written and oral form; draft opinions, pleadings, and briefs; independently present complex cases in court before judicial officials; communicate and cooperate with fellow staff members, agency representatives, judicial officers and the general public; and exercise independent judgment, discretion and initiative, especially in the charging and plea bargaining of criminal violations, in the application of limited law enforcement resources and in the decision to seek capital punishment.
