DEFINITION

Under direction, manages the code enforcement program in the Community Development Department; and does related or other work as required in accordance with Rule 3, Section 3 of the Civil Service Rules.

CLASS CHARACTERISTICS

This is the management class of the Code Enforcement Officer series. An employee of this single position class manages the Code Enforcement program and supervises the compliance with and enforcement of Building, Health and Safety and Zoning Codes, inspection and enforcement of substandard housing and dangerous buildings, abandoned vehicle abatement, cannabis, graffiti abatement, trash and junk, non-compliant land use and businesses, unpermitted structures or grading and related matters.

TYPICAL DUTIES

  • Plans, organizes, and directs, the activities and staff of the code enforcement division; assigns, trains, supervises, reviews and evaluates the work of subordinate inspectors and clerical staff through subordinate supervisors; ensures adequate staffing levels.
  • Develops or oversees development of policies and procedures related to gaining compliance with and enforcement of codes, establishes procedures for activities, interprets and explains policies and procedures to staff, agencies and members of the public; creates new and reviews and revises policies in response to changes in laws and regulations, changes in county codes, or from input from county staff and members of the public; plans and implements changes to improve operational efficiency.
  • Attends appeal hearings, depositions and court hearings as the department representative; assists Code Enforcement Officers to prepare factual presentations of cases; explains codes, policies, procedures and regulations and represents the department position.
  • Coordinates with County Counsel on Compliance Agreements, negotiates agreements with violators, prepares agreements using approved templates and submits to Director for final approval, monitors adherence to terms of Compliance Agreements and refers to County Counsel or the District Attorney if not in compliance.
  • Interprets federal, state, and county laws and regulations; reviews and analyzes proposed legislation to determine impact on program and advises Director of concerns; reviews and analyzes approved legislation and recommends implementation of new discretionary programs and implements mandated changes; ensures that inspectors are informed of changes in laws or enforcement practices.
  • Projects budget needs and costs; administers budget, moves funding as required to remain within allocation; may perform grant development and administration; participates in developing Requests for Proposals, reviews responses and selects vendors or consultants; writes or reviews contracts for services.
  • Participates in strategic planning for department, identifies trends in code enforcement, anticipates changes in needs, identifies staff and funding needed to meet anticipated needs.
  • Represents code enforcement to county agencies, fire districts, community organizations and members of the public; attends and presents at community meetings, coordinates code enforcement activities with other county agencies; coordinates community events.
  • Prepares staff reports and agenda items for Board of Housing Appeals, Planning Commission and Board of Supervisors and presents at meetings.

MINIMUM QUALIFICATIONS

Education: Graduation from an accredited four-year college or university with a major in Planning, Business or Public Administration, Construction, Criminal Justice, Social Sciences or related field.

Experience: Five years in planning/zoning, building inspection, code enforcement or related regulatory field including three years as a supervisor. 

Substitution: Additional qualifying experience may substitute for the required education on a year-for-year basis.
  
Certificate: Possession of a current Certified Code Enforcement Officer Certificate issued by the California Association of Code Enforcement Officials, OR current certification issued by the International Code Council (ICC) in at least one of the following Certified Code Safety Professional Exam fields: Property Maintenance and Housing Inspector, Zoning Inspector, Commercial Building Inspector or Residential Building Inspector within twelve months of appointment. 

Special Requirement: Must possess a valid Penal Code (PC) 832 Arrest, Search & Seizure Certificate within twelve months of appointment. 

License: Possession of a valid California driver’s license.

KNOWLEDGE

Duties and responsibilities of the Code Enforcement Program; principles and practices of supervision, training and development; principles of public administration; applicable state, federal and county laws and regulations; criminal and civil laws, legal processes and court procedures relating to code enforcement; techniques of code enforcement, investigation, inspection and interviewing; principles of negotiating and reaching agreement; conflict resolution techniques; basic public relations; budget preparation and monitoring; English usage, spelling, grammar and punctuation; report writing practices.

ABILITY

Plan, organize, manage and evaluate a code enforcement program; supervise, train, develop and motivate staff; interpret, enforce and apply State regulations and County Ordinance codes governing code enforcement, building, land use, waste management, zoning, housing, vehicle and nuisance abatement codes; conduct investigations and inspections; initiate legal action for issues of non-compliance; prepare concise correspondence and reports; read, understand, and interpret job related material, including technical and legal publications; make decisions on complex enforcement problems in accordance with established policies and procedures; establish and maintain program objectives, priorities and policies; consult with and advise top administrator on the activities and status of the program; develop long and short range plans; communicate effectively, both orally and in writing; establish and maintain effective working relationships with others.

PHYSICAL/MENTAL REQUIREMENTS

Mobility--Frequent operation of data entry device; occasionally standing, walking, crawling, bending/squatting, climbing ladders and stairs; frequent driving and sitting may be required; Lifting--occasionally lifting 5 to 70 pounds; Vision-frequent hand-eye coordination, depth perception, reading and close-up work; Dexterity--normal dexterity with occasional writing; Hearing/Talking--constant hearing and talking on the telephone/radio and in person; Emotional/Psychological--constant public contact and decision making with frequent concentration required; Special Requirements--may occasionally work weekends/nights; may be required to travel; Environmental Conditions--occasional exposure to noise and occasional expose to hazardous materials, dust, smoke, fumes, poor ventilation and changing indoor/outdoor conditions.
