DEFINITION

This is legal work of limited complexity and routine nature under the immediate supervision of an attorney. The work involves the performance of beginning and less difficult legal work such as the preparation of memoranda for legal opinions, investigation of cases pending in court, of claims filed against the County or any special districts, investigation of accidents involving County or any special districts, investigation of accidents involving County and district property, and personal inspection of premises and supervision of collection of claims due the County and special districts. The work requires some independent judgment and initiative although it is performed in accordance with established departmental rules and existing laws. Supervision is received from an attorney by frequent conferences and by review of reports and cases.

CLASS CHARACTERISTICS

This class provides for the employment of law students who have complete study in a law school of recognized standing and who are eligible to take the examination for admission to the State Bar of California. Appointees must furnish evidence of bar membership before expiration of the probationary period. Appointees will not be permitted to perform duties constituting practice of law until bar membership has been established.

TYPICAL DUTIES

  • Examines and interprets evidence; checks questions of law and evidence.
  • Aids in the preparation of trial briefs and in the organization of investigations.
  • Studies, interprets and applies laws, court decisions and other legal authorities for use in the preparation of cases, opinions, and briefs.
  • Confers with investigators regarding the collection of facts; makes investigations to collect facts; locates witnesses and parties.
  • Performs related work as required.

MINIMUM QUALIFICATIONS

Education: Graduation from a recognized school of law.

KNOWLEDGE

Some knowledge of the principles of law and their application. Some knowledge of trial procedures and the rules of evidence. Some knowledge of legal research methods and the preparation of briefs and opinions. Some knowledge of county government functions and legal responsibilities.

ABILITY

Analyze, apply legal principles, facts, evidence, and precedents to legal problems. Ability to present statements of law, fact and argument clearly and logically in written and oral form. Ability to establish and maintain harmonious and cooperative relationships with fellow staff members, departmental representatives, and the general public. Ability to perform research and prepare legal opinions.
