Description of Occupational Work

This class series uses three levels in the Administrative Services occupational group, Fiscal Services occupational series and describes the examination of unclaimed property financial records and legal documentation to determine authenticity of refund claims by owners for property escheated to the State of Delaware in accordance with the Delaware Code.  A class incumbent examines claims and makes recommendations based on analysis of documentation, research, evidentiary requirements, and accounting and other related principles, practices and procedures.  Claims analyzed range from small domestic claims amounting to less than ten dollars up to large claims amounting to as much as several million dollars.  The level of complexity in the claims analyzed range from basic claims owned by a single individual owner to claims with joint owners, UGMA (Uniform Gifts to Minors Act), Trusts, Estates, Heir, Royalties, and Minerals for both domestic and foreign property owners and businesses.  Furthermore, the volume of claims and the potential for fraudulent claims requires a class incumbent to consistently and carefully apply all relevant laws and procedures to ensure that the rightful owners are paid after a reasonable period of review.  

Note: This career ladder series incorporates the Unclaimed Property Claims Examiner levels I and II.  Based on the level of work applicable to the employing agency and functional area, positions can be allocated up to level II.  The I level is to provide entry for hiring new employees into the class series but does not preclude hiring new employees at higher levels.  Employees may be promoted through the career ladder in accordance with job requirements and promotional standards. Promotional standards, a selection document under separate cover, sets forth the criteria that defines and describes the requirements that must be met at each level.  Advancement of employees through the career ladder is dependent on an agency's/department's operational needs and distribution of work.

The Unclaimed Property Claims Supervisor level, although not part of the career ladder, provides competitive opportunity for movement of employees.

Essential Functions

Essential functions are fundamental, core functions common to all positions in the class series and are not intended to be an exhaustive list of all job duties for any one position in the class. Since class specifications are descriptive and not restrictive, incumbents can complete job duties of similar kind not specifically listed here.

  • Examines claims which includes collecting, analyzing and evaluating financial records and legal documentation (foreign and domestic), from a variety of sources such as claims from individuals, estates, corporations, government agencies, law firms, etc. 
     
  • Determines the type of claim documentation required for the return of property, as well as authenticity of documents and ownership of property through an evidentiary process.
     
  • Approves or denies claims by applying relevant state and federal laws, regulations, rules, and internal policies, procedures, and controls related to any of the following or any other relevant area: unclaimed property and escheat; tax; accounting; insurance; workers’ compensation; labor; or claims.    
     
  • Conducts compliance review of the receipt, inventory, safeguarding, and reconcilement of securities and related property to ensure all claims transactions comply with relevant state and federal laws, regulations, rules, and internal policies, procedures, and controls related to any of the following or any other relevant area: unclaimed property and escheat; tax; accounting; insurance; workers’ compensation; labor; or claims. 
     
  • Performs complex calculations to determine the return of securities to ensure adherence with relevant state and federal laws, regulations, rules, and internal policies, procedures, and controls related to any of the following or any other relevant area: unclaimed property and escheat; tax; accounting; insurance; workers’ compensation; labor; or claims.  
     
  • Communicates verbally and in writing with multiple units within the Department such as the Enforcement, Fraud Prevention and Holder Reporting units, as well as internal and external customers, to explain legal requirements, authenticate ownership, ensure properties claimed are eligible for refund, and to provide information regarding the progress of a claim.
     
  • Ensures potentially fraudulent activity is escalated and investigated.
     
  • Follows, develops, and recommends policies and procedures consistent with relevant state and federal laws, regulations, rules, and internal policies, procedures, and controls related to any of the following or any other relevant area: unclaimed property and escheat; tax; accounting; insurance; workers’ compensation; labor; or claims.    
     
  • Prepares written reports including claims examination findings and recommendations.
     
  • Utilizes computer software to perform audit and analysis.

Levels of Work

Unclaimed Property Claims Examiner I

This is the first level of unclaimed property claims examiner work encompassing the full range of Essential Functions.

  • Work is performed under the direction of a technical superior.  Receives close supervision in processes and procedures. Work is reviewed in progress.
  • Conducts less complex claims examinations and participates, with oversight by a technical superior, in more complex claims examinations.  Complex examinations may include the review of foreign documentation, official translations, legal documentation related to estates, trusts, and inheritance, and stock/securities related properties.
  • Consults with higher level Examiners for issues that are outside the range of specified, acceptable procedures, standards, and practices.
  • Identifies suspicious documentation for the purpose of referral to a fraud investigator.
  • Responds to telephone and written communication, including but not limited to automated call distribution lines and general e-mail boxes; and provides assistance for walk-in public service offices.
  • Coordinates with administrative support staff for the purpose of ensuring clerical assignments are properly executed.

Unclaimed Property Claims Examiner II

This is full performance of unclaimed property claims examiner work.  

  • Receives less supervisory direction and assistance than at the I level. Supervisor does periodic review of progress.
  • Performs complex claims examination and analysis of diverse financial transactions and system processes to ensure proper application of escheat laws, policies and procedures.  Complex examinations may include the review of foreign documentation, official translations, legal documentation related to estates, trusts, and inheritance, and stock/securities related properties.
  • Provides guidance and direction to lower-level professional staff, including the resolution of escalated issues or inquiries.
  • Approves high-dollar financial transactions and may be the final level approver for refund issuance; identifies and recommends solutions to complex claimant/owner problems.
  • Prepares payment batches, as well as production and management reports such as production volumes, accuracy, customer service levels, etc.
  • Leads and recommends on-going functional changes of system transactions, operating system functionality, and procedures for process improvements. 
  • Assists with special projects and enhancements.
  • May attend hearings of the Tax Appeal Board as a witness.

Unclaimed Property Claims Supervisor

This is the supervisory level of unclaimed property examination work.

  • Supervision is exercised over at least two or more merit full time positions per the Merit Rules. The elements of supervision include planning, assigning, reviewing, evaluating, coaching, training, recommending hire/fire and discipline.  May also supervise third party vendors, contractors, and project staff, in addition to merit staff.
  • Conducts and supervises the examination of payment/refund/return of abandoned property claims.  Provides the highest-level approval, expertise and oversight within this series.
  • Reviews progress of claims inventories and backlog, monitors management level production metrics, ensures staff adherence to policies and procedures.  Prepares Executive Level reporting of unit's progress.
  • Analyzes agency policies and procedures and makes recommendations to senior leadership related to internal control improvements and efficiencies in services provided.  
  • Leads the planning, development and implementation of enhancements and modifications to a complex automated system. May require the integration of new technologies or design of user acceptance testing plans and teams.
  • Responsible for team and individual interactions with internal customers (enforcement staff, securities, holder reporting, fraud), state and federal claims, high profile corporate filers, and legal counsel.  Unclaimed Property liaison for all constituent relations inquiries.
  • Confers with property owners and/or their accounting/legal representatives on escalated issues related to examination findings and complex requirements. Advises claimants/owners and their representatives of their right to appeal the Office's determinations.

  • Ability to write clear, concise working papers, analysis summaries, draft findings and recommendations.
  • Ability to communicate effectively verbally (in person and by telephone) and in writing.
  • Ability to meet production deadlines.

In addition to the above Knowledge, Skills and Abilities, the Unclaimed Property Claims Examiner II requires:

  • Knowledge of financial information systems.
  • Skill in analyzing diverse financial records, transactions and legal documentation (foreign and domestic). 
  • Skill in the research, interpretation and application of state and federal unclaimed laws, regulations, rules and codes related to any of the following or any other relevant area: unclaimed property and escheat; tax; accounting; insurance; workers’ compensation; labor; or claims.
  • Skill in resolving complex claim issues and inquiries.
  • Skill in using multiple fraud prevention and data authentication tools.
  • Skill in interviewing and investigative techniques and procedures.
  • Skill in writing clear, concise working papers, analysis summaries, draft findings and recommendations.
  • Skill in preparing a variety of reports.
  • Skill in recommending process/customer service improvements, solutions and/or system enhancements.

In addition to the above Knowledge, Skills and Abilities, the Unclaimed Property Claims Supervisor requires:

  • Knowledge of supervisory principles and practices.
  • Skill in the development of claims examination plans and procedures.
  • Skill in establishing goals, objectives and priorities in accordance with the department's overall mission.
  • Ability to negotiate and resolve the most complex unclaimed property issues and inquiries. 
  • Ability to plan, coordinate and implement complex projects.

Job Requirements

JOB REQUIREMENTS for Unclaimed Property Claims Examiner II
Applicants must have education, training and/or experience demonstrating competence in each of the following areas:

  1. Two years’ experience in compiling, analyzing and interpreting legal or financial data to ensure effective and efficient accounting of funds.
  2. One year experience in customer service such as providing prompt, accurate, and courteous service to customers seeking information, answering requests as quickly as possible, ensuring customers are satisfied with service, and responding to complaints.
  3. Two years’ experience in interpreting laws, rules, regulations, standards, policies, and procedures
  4. One year experience in writing reports in a structured format containing an introduction, presenting the thesis, purpose or proposal with supporting evidence, explanation, facts, and analysis or examples with a conclusion or recommendations.
