Alcohol & Tobacco Enforcement Agent II (#MBBA02)

This class is responsible for conducting investigations, inspections and enforcement of liquor establishments for compliance with applicable state and federal laws, rules and regulations and overseeing/training lower level agents.

A class incumbent functions under the supervision of the Alcohol and Tobacco Enforcement Field Supervisor. Work involves conducting civil and criminal investigations and arresting and prosecuting violators of crimes against state and federal Alcohol and Tobacco Enforcement laws, rules and regulations and related criminal statutes concerning gambling, narcotics, prostitution and tax evasion. Adjunct to Alcohol and Tobacco Enforcement, an incumbent is responsible for performing inspections of establishments for initial licensing, transferring licenses, alterations, etc, auditing warehouse inventories, assisting in providing server training and participating in field training of Agent I's. Work includes coordinating multiple police jurisdictions in controlling potentially violent situations. An incumbent is responsible for on-site, tactical enforcement activities of seizing evidence and sell-backs. A significant aspect of this work involves hazardous conditions, often working alone in undercover capacities frequently with intoxicated people bearing lethal weapons. The nature of this work requires frequent night duty and working hours in excess of the standard work week, including weekends, holidays and shift work.

• Identifies and implements compliance and enforcement priorities within assigned areas.
   
• Recognizes, gathers and reports evidence of illegal activities.
   
• Protects the public through education and enforcement.
   
• Participates in overseeing/field training lower level Agents. Provides input to Alcohol and Tobacco Enforcement Field Supervisor on Agent's performance.
   
• Coordinates with other law enforcement agencies including the State Police, State Bureau of Investigation and local law enforcement entities.
   
• Performs wholesaler warehouse inventories for state tax compliance.
   
• Conducts criminal investigations including undercover and surveillance activities.
   
• Makes arrests, completes investigative and compliance reports to include crime reports that are submitted to the State Bureau of Identification; reports may be used in court cases; prosecutes cases in Court and testifies before the Alcohol and Tobacco Enforcement Commission.
   
• Performs inspections of liquor establishments for initial licensing, transferring licenses, alterations, renovations, etc. to ensure compliance with all applicable laws, rules and regulations.  Informs applicant/licensee of violations/corrective actions and follows-up to ensure appropriate actions have been taken and collects fees.

JOB REQUIREMENTS for Alcohol & Tobacco Enforcement Agent II
Applicants must have education, training and/or experience demonstrating competence in each of the following areas:

1. Possession of an active State of Delaware Council on Police Training Certificate or equivalent, OR eligibility for recertification per Delaware Administrative Code Title 1, Chapter 801, Section 8.0 Re-activation Requirements of Police Officers.
2. At least one year experience as a Certified Police Officer.
3. Possession of a valid Driver's License (not suspended, revoked or cancelled, or disqualified from driving).
4. Six months experience in conducting investigations which includes conducting interviews to obtain confidential information, gathering evidence and documenting findings.
5. Six months experience in ensuring compliance with alcohol and tobacco laws, rules, regulations, standards, policies, and procedures.
