Description of Occupational Work

This class series uses two levels and describes court enforcement work, serving and executing a wide variety of legal documents consisting of civil and criminal court orders in accordance with court rules and procedures.  Work includes exercising independent judgment and discretion in handling potentially explosive situations. In performing their work, employees in this class normally work alone, are responsible for covering large areas of the state and have the power of arrest.  A significant aspect of this work is dealing firmly but courteously with hostile members of the public.   

Note: This career ladder series incorporates the Constable I and Constable II.   Based on the level of work applicable to the employing agency and functional area, positions can be allocated up to level the Constable II. The Constable I level is to provide entry for hiring new employees into the class series but does not preclude hiring new employees at higher levels.  Employees may be promoted through the career ladder in accordance with job requirements and promotional standards. Promotional standards, a selection document under separate cover, sets forth the criteria that defines and describes the requirements that must be met at each level.  Advancement of employees through the career ladder is dependent on an agency's/department's operational needs and distribution of work. 

Essential Functions

Essential functions are fundamental, core functions common to all positions in the class series and are not intended to be an exhaustive list of all job duties for any one position in the class.  Since class specifications are descriptive and not restrictive, incumbents can complete job duties of similar kind not specifically listed here.
  • Serves civil and criminal court orders such as subpoenas, summonses and other legal documents on defendants, their attorneys or other legally recognized representatives in an assigned jurisdiction; also, executes warrants such as capias, contempt of court and truancy.
  • Makes levies on personal property against which a judgment has been obtained; appraises real or personal property; posts notices for constable sales; acts as or oversees auctioneers and sells property levied upon to satisfy a judgment.
  • Serves court orders directing evictions or seizure of property; takes inventory of goods removed; provides security to all parties involved.
  • Performs investigations to locate defendants who have moved or are attempting to evade service by contacting/questioning neighbors, managers of apartment buildings, store owners, police agencies, and local post offices.
  • Assists judges in maintaining law and order in the court and in waiting areas.
  • Contacts by mail and telephone defendants, plaintiffs, their attorneys and others on matters affecting the service and execution of legal documents.
  • Uses an automated information system to enter, update, modify, delete, retrieve/inquire and report on data.
  • Makes bank deposits; delivers and retrieves court documents to and from other courts, state offices, businesses and/or post offices.
  • May transport prisoners, including juveniles, to penal institutions within the state and/or other courts as directed by the court.

Levels of Work

Constable I

This is the first level of constable work performing the full range of Essential Functions under close supervision.  

  • Reports to an administrative supervisor.
  • Attends Department approved security, weapons qualification and other training programs.
  • Assists Constable II staff with more complex constable work.
  • Contacts are with the public, police and other law enforcement agencies, judges, attorneys, court staff and others for the purpose of serving criminal and civil documents, executing warrants, locating defendants, and holding constable sales.

Constable II

This is the second level of constable work.

  • Independently makes levies on personal property against which a judgment has been obtained; appraises real or personal property; posts notices for constable sales; acts as or oversees auctioneers and sells property levied upon to satisfy a judgment.
  • Serves and executes civil and criminal court orders more likely to result in hostile or volatile situations involving sensitive matters, remote locations, and/or members of the public with a history of violence/criminal background.
  • May provide technical guidance to lower-level staff.

Knowledge, Skills and Abilities

The intent of the listed knowledge, skills and abilities is to give a general indication of the core requirements for all positions in the class series; therefore, the KSA’s listed are not exhaustive or necessarily inclusive of the requirements of every position in the class.
  • Knowledge of applicable law regarding the service and execution of court documents.
  • Knowledge of the methods of court enforcement and security.
  • Knowledge and proficiency in the care and proper use of firearms.
  • Knowledge of the use of deadly force.
  • Knowledge of using an automated information system to enter, update, modify, delete, retrieve/inquire and report on data.
  • Ability to establish and maintain effective working relationships with the public, associates and others.
  • Ability to work independently.
  • Ability to handle situations firmly, tactfully and with respect for the rights of others.
  • Ability to recognize potentially explosive situations and respond quickly and calmly in an emergency.
  • Ability to maintain accurate records.

In addition to the above knowledge, skills and abilities, the Constable II requires:

  • Knowledge of appraising real or personal property.
  • Skill in using an automated information system to enter, update, modify, delete, retrieve/inquire and report on data.
  • Skill in defensive tactics and devices including firearms.
  • Skill in assessing, communicating and influencing diverse groups of people in stressful situations.

Job Requirements

JOB REQUIREMENTS for Constable I
Applicants must have education, training and/or experience demonstrating competence in each of the following areas:

  1. Six months experience in security such as providing protective services to persons, facilities or grounds from trespassing, theft and other conditions.
  2. Six months experience in record keeping.
  3. Six months experience in using an automated information system to enter, update, modify, delete, retrieve/inquire and report on data.
  4. Possession of a valid Driver's License (not suspended, revoked or cancelled, or disqualified from driving).
