Summary Statement

This is the first level of constable work performing the full range of Essential Functions under close supervision.

Essential Functions

Essential functions are fundamental, core functions common to all positions in the class series and are not intended to be an exhaustive list of all job duties for any one position in the class.  Since class specifications are descriptive and not restrictive, incumbents can complete job duties of similar kind not specifically listed here.

  • Serves civil and criminal court orders such as subpoenas, summonses and other legal documents on defendants, their attorneys or other legally recognized representatives in an assigned jurisdiction; also, executes warrants such as capias, contempt of court and truancy. 
  • Makes levies on personal property against which a judgment has been obtained; appraises real or personal property; posts notices for constable sales; acts as or oversees auctioneers and sells property levied upon to satisfy a judgment. 
  • Serves court orders directing evictions or seizure of property; takes inventory of goods removed; provides security to all parties involved.
  • Performs investigations to locate defendants who have moved or are attempting to evade service by contacting/questioning neighbors, managers of apartment buildings, store owners, police agencies, and local post offices. 
  • Assists judges in maintaining law and order in the court and in waiting areas. 
  • Contacts by mail and telephone defendants, plaintiffs, their attorneys and others on matters affecting the service and execution of legal documents. 
  • Uses an automated information system to enter, update, modify, delete, retrieve/inquire and report on data. 
  • Makes bank deposits; delivers and retrieves court documents to and from other courts, state offices, businesses and/or post offices. 
  • May transport prisoners, including juveniles, to penal institutions within the state and/or other courts as directed by the court.

Job Requirements

JOB REQUIREMENTS for Constable I
Applicants must have education, training and/or experience demonstrating competence in each of the following areas:

  1. Six months experience in security such as providing protective services to persons, facilities or grounds from trespassing, theft and other conditions. 
  2. Six months experience in record keeping. 
  3. Six months experience in using an automated information system to enter, update, modify, delete, retrieve/inquire and report on data. 
  4. Possession of a valid Driver's License (not suspended, revoked or cancelled, or disqualified from driving).

Additional Posting Information

This position is a classification organized under an exclusive bargaining representative (labor organization) that has been elected by employees as their representative for collective bargaining and other applicable terms and conditions of employment, in accordance with Title 29, Chapter 59 and Title 19, Chapter 13 and 16.  This position is covered by a collective bargaining agreement based on its individual terms.

Conditions of Hire

Applicants must be legally authorized to work in the United States. Criminal background check: A satisfactory criminal background check is required as a condition of hire.  The recruiting agency may require the applicant to pay for the criminal background check as part of the conditional offer of hire.

Pre-employment Drug Testing:  Upon a conditional offer, you must undergo pre-employment drug testing as part of the hiring process.

As a condition of hire the applicant must agree to successfully complete a 50 hour training program in firearms and training in handcuffs, mace, baton, and wand approved by the State of Delaware Council on Police Training. Possession of a State of Delaware Council on Police Training Certification may satisfy this requirement.

Pre-Employment Psychological Testing: Upon a conditional offer, you must undergo pre-employment psychological testing as part of the hiring process.
