NATURE OF WORK

A Financial Non-Depository Examiner Supervisor is the supervisory level of financial examination work.  Employees in this classification supervise the examination of the accounts, records, consumer transactions and business practices of non-depository financial institutions (i.e., consumer loan, sales finance, installment loan, mortgage lenders, collection agencies, check cashiers, money transmitters and debt management companies) primarily located at the business’ headquarters.  Employees in this classification perform complete examinations designed to ensure that the financial institutions are in compliance with laws and regulations governing their operations or individual compliance reviews resulting from the receipt of consumer complaints.  Employees in this classification supervise lower-level Financial Non-Depository Examiners.

Employees in this classification receive general supervision from a higher-level manager or other designated administrator.  The work may require travel throughout the State and in some instances the United States, including overnight travel.

Positions in this classification are evaluated by using the classification job evaluation methodology.  The use of this method involves comparing the assigned duties and responsibilities of a position to the job criteria found in the Nature of Work and Examples of Work sections of the class specification.

The Financial Non-Depository Examiner Supervisor is differentiated from the Financial Non-Depository Examiner Lead and the Financial Non-Depository Examiner Advanced in that the Financial Non-Depository Examiner Supervisor has supervisory responsibility for lower-level Financial Non-Depository Examiners, while the Financial Non-Depository Examiner Lead assigns, reviews and approves the work of and trains lower-level Financial Non-Depository Examiners and the Financial Non-Depository Examiner Advance functions as the Examiner-in-Charge with full responsibility for the entire examination team of lower-level Financial Non-Depository Examiners.

EXAMPLES OF WORK

Plans, coordinates, supervises, trains, and evaluates the work of lower-level Financial Non-Depository Examiners;

Provides technical expertise and training on topics related to the examination of financial institutions’ records and operations, adequacy of management, quality of investments, systems and controls, and other major aspects of the examinations and supervision;

Examines the records and accounts of non-depository financial institutions to ensure compliance with laws and regulations;

Examines collateral to loans to determine its value;

Audits all aspects of insurance products, such as placements, service charges, payments, homeowners insurance, voluntary unemployment, title and non-filing insurance issued by non-depository companies;

Examines all repossessions for proper compliance with rights of redemption, accounting of sale proceeds and determination as to a bona-fide sale;

Examines all facets of foreclosures of real property, including reconciling balances to account for charges and expenses incurred during the sale;

Reviews, analyzes and investigates consumer complaints;

Discusses examination findings with non-depository institution’s management staff to ensure compliance with Report recommendations;

Prepares and negotiates consent agreements with regulated institutions when violations are found in the examination process;

Recommends enforcement actions including consent orders, suspensions, revocations, cease and desist orders or the filing of charges to remove the license of serious violators;

May determine the financial condition of institutions to protect consumers;

May prepare schedules and work papers detailing the financial condition, level of compliance and all other policies and practices of the non-depository institution;

May rate the overall financial condition of non-depository institutions by applying the appropriate standards;

May rate the quality of loans and lending practices of non-depository institutions by applying the appropriate standards;

May determine and verify the value of investment portfolios;

May prepare draft reports of examinations and review findings for final approval;

May rate the level of compliance with the various consumer protection laws by applying the appropriate standards;

May analyze mortgage loans for predatory lending practices such as property flipping, inflated loans, over-valued appraisals and verification of income sources for the protection of consumers;

May research trend analysis of complaints against licensees in order to conduct targeted examinations and develop examination findings for violations of State or federal laws, rules and regulations;

May research and draft responses on proposals, such as the interpretation of statutes, from various entities or attorneys, pertaining to State or federal laws, rules and regulations;

May respond to emergencies, such as foreclosure attempts by licensees, emerging issues, and current issues by developing strategies and recommending ways to effectively resolve the issues;

Performs other related duties.

KNOWLEDGE, SKILLS AND ABILITIES

Knowledge of the laws and regulations governing all non-depository institutions licensed to operate in Maryland;

Knowledge of the theory, principles and practices of auditing and accounting;

Knowledge of lending policies and practices, loan underwriting procedures and credit administration practices;

Knowledge of business practices and procedures of non-depository institutions;

Knowledge of computerized financial reporting and accounting systems;

Skill in using automated data processing information systems, personal computers and software related to examinations;

Skill in evaluating the accuracy, adequacy and propriety of manual and computerized accounts and reports generated from financial transactions;

Skill in interpreting and applying governing laws, rules, regulations and procedures to specific situations;

Skill in analyzing records and developing specific information associated with the purpose of the examination;

Skill in preparing complete and accurate work papers and narrative reports;

Ability to supervise lower-level Financial Non-Depository Examiners;

Ability to establish and maintain effective working relationships with other examiners, agency staff, agency management personnel, representatives from the financial services industry, attorneys, and federal officials.

MINIMUM QUALIFICATIONS

Experience: Nine years of experience, five years of experience examining or auditing the accounts, records and business practices of non-depository financial institutions or in managerial or professional work in the financial services, consumer loan, sales finance, installment loan, mortgage lenders, collection agencies, check  cashiers, money transmitters, debt management and/or law enforcement industries and four years of additional regulatory, managerial or professional experience in the financial services industry, consumer credit industry, mortgage lending industry, accounting or auditing work or State or federal regulatory experience in the above industries.

Notes:

1. Candidates may substitute the possession of a Bachelor's degree from an accredited college or university including or supplemented by a total of 24 credit hours in business administration, finance, economics, law, criminal justice or accounting and five years of experience examining or auditing the accounts, records and business practices of non-depository financial institutions or in managerial or professional work in the financial services, consumer loan, sales finance, installment loan, mortgage lenders, collection agencies, check cashiers, money transmitters, debt management and/or law enforcement industries for the required experience.  These credit hours must include a minimum of 6 credit hours in either accounting or auditing.

2. Candidates may substitute the possession of a Juris Doctor degree from an accredited law school, a certificate as a Certified Public Accountant, or a Master’s degree in business administration or accounting from an accredited college or university for one year of the required experience.

3. Candidates may substitute U.S. Armed Forces military service experience as a commissioned officer in logistics specialist classifications or administrative support specialty codes in the financial management or auditing fields of work on a year-for-year basis for the required experience.

LICENSES, REGISTRATIONS AND CERTIFICATIONS

Employees in this classification may be assigned duties which require the operation of a motor vehicle. Employees assigned such duties will be required to possess a motor vehicle operator’s license valid in the State of Maryland.

SPECIAL REQUIREMENTS

Employees in this classification may be required to attend advanced formal training classes.  The purpose of this training is to maintain professional job specific proficiency and current knowledge.  Some training classes are out-of-State and may require overnight stays.

This is a Skilled Service classification in the State Personnel Management System.  All positions in this classification are Skilled Service positions.  Some positions in Skilled Service classifications may be designated Special Appointment in accordance with the State Personnel and Pensions Article, Section 6-405, Annotated Code of Maryland.

This classification is not assigned to a bargaining unit as indicated by the designation of S (supervisor), M (manager), T (agency head), U (Board or Commission member), W (student), X (excluded by executive order),  or Z (confidential).  As provided by State Personnel and Pensions Article, Section 3-102, special appointment, temporary, contractual, supervisory, managerial and confidential employees are excluded from collective bargaining.  Additionally, certain executive branch agencies are exempt from collective bargaining and therefore, all positions in those agencies are excluded from collective bargaining.
