NATURE OF WORK

A Procurement Manager IV is the second managerial level of professional work in agency procurement sourcing and award activities, contract management, procurement systems operations, procurement regulations and policies review, professional procurement training and certification, or procurement business services located in the Department of General Services (DGS), the State central procurement authority.     Employees in this classification provide highest level control agency management procurement technical interpretation, instruction, guidance and assistance in accordance with State laws and regulations. Employees in this classification supervise Procurement Managers and lower-level Procurement Officers.

Employees in this classification receive managerial supervision from a designated administrator.  The work may require travel throughout Maryland to perform on-site procurement audits, training, monitoring, compliance reviews at State agencies.

Positions in this classification are evaluated using the classification job evaluation methodology.  The use of this method involves comparing the assigned duties and responsibilities of a position to the job criteria found in the Nature of Work and Examples of Work sections of the class specification.

EXAMPLES OF WORK

Plans, directs and administers procurement operations of a DGS procurement control activity with diverse and complex requirements;

Plans, coordinates, supervises and evaluates the work of Procurement Managers and lower-level Procurement Officers;

Assesses DGS procurement operations and identified activities that require additional monitoring or control and develops and implements corrective action plans;

Provides instruction, direction and guidance to contract and procurement personnel statewide in all aspects of the procurement process by attending pre-bid or pre-proposal conferences, meeting with agency procurement staff to discuss results of procurement analyses;

Assists with and manages state contracts after award;

Reviews, analyzes and approves contract documents from other State agency procurement personnel for content and format, to ensure adherence to State procurement laws, regulations, policies and procedures, and to prevent duplicate and unnecessary procurements;

Determines basis for awards and evaluation criteria;

Develops contract specifications including performance and acceptance standards, payment terms, contract management elements, contract modifications, contract renewals and advertisement requirements in accordance with State procurement procedures, laws and regulations for the procurement of all necessary services, supplies, equipment, real estate, construction, indefinite quantity contracts, facilities maintenance and commodities;

Manages statewide indefinite quantity contracts;

Conducts pre-bid/pre-proposal conferences, site inspections, explains procurement requirements;

Establishes procurement procedures, and schedules, participates in, and conducts offerors’ discussions and contract negotiations;

Examines bid proposals to determine issues of responsiveness and responsibility and need for additional information;

Conducts bid openings for competitive procurements to determine whether offerors are qualified to be selected for award and may recommend proposals for awards;

Manages the advertisement of procurement opportunities, distributes specifications to vendors, conducts vendor conferences, receives and secures bid or proposals, oversees the evaluation process and contract award;

Assists with or conducts debriefings;

Negotiates the most favorable prices, terms and conditions for noncompetitive sole source and emergency procurements;

Researches materials and provides testimony regarding Board of Public Works items and prepare documents for BPW contract approval;

Prepares minutes of pre-bid/pre-proposal conferences, addenda to Requests for Proposals (RFP)/Invitation for Bids (IFB) and answers written questions from potential bidders and offerors;

Assembles statistical and narrative data and prepares reports for use in evaluating State procurement activity and performance measurement;

Provides testimony in bid protest disputes;

Evaluates contractor’s performance against terms and conditions of contracts and recommends corrective actions, such as the application of damages, withholding of payment or termination of contract;

Confers with Assistant Attorney General’s Office regarding bid irregularities, contract disputes, protests, vendor compliance or appeals and Public Information Act requests;

Verifies Certificates of Insurance, Bonds and references for compliance with contract requirements;

Verifies Minority Business Enterprise (MBE) participation;

Implements new and revised fiscal policies, procedures and standards to capture complex procurement costs;

May review financial reports to determine and maintain effective internal controls to insure the accuracy and reliability of procurement fiscal records and to protect fiscal resources from fraud and waste;

May review performance standards and evaluates fiscal activities, records and reports to determine if the information provides sound financial basis for making sound fiscal judgments;

May support changes to be made to the structure of electronic procurement computer network system based on agency requirements;

May direct the installation and customization of applications software for the eProcurement system;

May oversee the configuration of network software and hardware to provide for efficient and effective network performance and data security;

May review prepared and assembled technical documentation and user documentation for network software and hardware;

May monitor the performance of the network software and hardware through network management and diagnostic programs and utilities, adjusts the network for maximum efficiency, maintains and analyzes records of network activity;

May manage the diagnosis of network software and hardware problems and ensure repairs and adjustments are made service is obtained from software and hardware vendors and maintenance vendors;

May oversee backups of network data, archives data as required and the development and maintenance of disaster recovery plans;

May administer certification components of the DGS procurement manpower development and training activities;

May coordinate the identification of training objectives, curricula, review progress of coursework, approve the provision of training programs and requests for training activities;

May approve the negotiations with external professional certification organizations and training resources to obtain State credentials, arrange for the provision of academic courses, and to coordinate development programs;

May oversee the conduct instructional activities in specialized training programs;

May provide advice and guidance to paraprofessional support staff;

Performs other related duties.

LICENSES, REGISTRATIONS AND CERTIFICATIONS

1.  Employees in this classification may be assigned duties which require the operation of a motor vehicle.  Employees assigned such duties will be required to possess a motor vehicle operator’s license valid in the State of Maryland.

2.  Employees in this classification, who have not already done so, must obtain and possess certification as a Procurement Profession from the Maryland Department of General Services within one year of appointment.

This is a Management Service classification in the State Personnel Management System.  All positions in this classification are Management Service positions.

This classification is not assigned to a bargaining unit, as indicated by the designation of S (Supervisor), M (Manager), T (Agency Head), U (Board or Commission Member), W (Student), X (Used by Agency or Excluded by Executive Order), or Z (Confidential).  As provided by State Personnel and Pensions Article, Section 3-102, special appointment, temporary, contractual, supervisory, managerial and confidential employees are excluded collective bargaining.  Additionally, certain executive branch agencies are exempt from collective bargaining and all positions in those agencies are excluded from collective bargaining.
