A MBP Compliance Analyst Associate, Investigations is the entry level of work with the Maryland Board of Physicians (MBP) in the investigation of complaints against Physicians and allied health care providers that may involve violations of the Maryland Medical Practice Act. Employees in this classification do not supervise other positions.
Employees in this classification receive close supervision from a MBP Compliance Analyst Supervisor, Investigations, MBP Compliance Analyst Supervisor, Intake or MBP Compliance Chief, Investigations. The work requires travel to various locations throughout the state such as medical offices and health care facilities.
Positions in this classification are evaluated by using the classification job evaluation methodology. The use of this method involves comparing the assigned duties and responsibilities of a position to the job criteria found in the Nature of Work and Examples of Work sections of the classification specification.
The MBP Compliance Analyst Associate, Investigations is differentiated from the MBP Compliance Analyst, Investigations based on the degree of supervisory control exercised by the supervisor over these employees. The MBP Compliance Analyst Associate, Investigations performs duties under close supervision while the MBP Compliance Analyst, Investigations performs the full range of duties and responsibilities under general supervision.
Learns to investigate complaints against Physicians and allied health care providers that may involve violations of the Maryland Medical Practice Act;
Learns to examine documents and records, conduct research and analysis of preliminary information and assists in determining the validity of complaints;
Learns to identify relevant issues, determine grounds of case, regulations and Board precedents applicable to the facts of the case and recommend case strategy and investigative approach;
Learns to conduct individual case investigations and participate in team investigations;
Learns to conduct research to understand all aspects of the complaint, including relevant medical and legal issues;
Learns to examine legal and medical records relevant to investigations;
Learns to identify and interview complainants, respondents, and witnesses and obtain signed statements when warranted;
Learns to prepare and serve subpoenas and other related official documents for the collection of physical and documentary evidence;
Learns to coordinate, identify and collect physical evidence and report information using camera, telephone and other evidence collection tools to preserve the chain of custody and prepare a completed investigation file in accordance with established procedures;
Learns to consult with regulatory or law enforcement agencies, and expert witnesses on an as needed basis;
Learns to participate in announced and unannounced site visits, conduct field assignments and medical office inspections to cite and record violations of the Maryland Medical Practice Act;
Learns to determine eligibility of applicants for licensure;
Learns to draft clear and concise reports and memoranda related to the process and findings of the investigation for supervisory review;
Learns to coordinate and assist in case preparation with the Office of the Attorney General;
Learns to testify at administrative hearings and other court proceedings;
May conduct routine debriefings on closed cases to identify areas in need of improvement and assist in ensuring that each case is reviewed by the Prosecutor before being presented to the Board for charging;
Performs other related duties.
Experience: Four years of experience conducting investigations in the area of health care, insurance, medical malpractice or other related investigative experience as defined by the Maryland Board of Physicians.

1. Candidates may substitute the possession of a Bachelor's degree from an accredited college or university for the required experience.
2. Candidates may substitute U.S. Armed Forces military service experience as a commissioned officer in Legal or Investigator classifications or Legal or Investigator specialty codes in the Investigation field of work on a year-for-year basis for the required experience.

This is a Skilled Service classification in the State Personnel Management System. All positions in this classification are Skilled Service positions. Some positions in Skilled Service classifications may be designated Special Appointment in accordance with the State Personnel and Pensions Article, Section 6-405, Annotated Code of Maryland.
This classification is not assigned to a bargaining unit, as indicated by the designation of S (Supervisor), M (Manager), T (Agency Head), U (Board or Commission Member), W (Student), X (Used by Agency or Excluded by Executive Order), or Z (Confidential). As provided by State Personnel and Pensions Article, Section 3-102, special appointment, temporary, contractual, supervisory, managerial and confidential employees are excluded from collective bargaining. Additionally, certain executive branch agencies are exempt from collective bargaining and all positions in those agencies are excluded from collective bargaining.
This classification is one level in a Non-Competitive Promotion (NCP) series. NCP promotions are promotions by which employees may advance in grade and class level from trainee to full performance level in a classification series. In order to be non-competitively promoted to the next level in a NCP series, an employee must: 1) perform the main purpose of the class, as defined by the Nature of Work section of the class specification; 2) receive the type of supervision defined in the class specification and 3) meet the minimum qualifications of the classification.
