A MBP Compliance Analyst Senior, Investigations is the advanced level of work with the Maryland Board of Physicians (MBP) in the investigation of complex cases and complaints against Physicians and allied health care providers that may involve violations of the Maryland Medical Practice Act. Employees in this classification investigate cases and complaints involving specialized and sub-specialized areas of medical practice or significantly advanced medical theories, concepts and principles. Employees in this classification do not supervise other positions.
Employees in this classification receive general supervision from a MBP Compliance Analyst Supervisor, Investigations, MBP Compliance Analyst Supervisor, Intake, MBP Compliance Chief Investigations, or other authority in the office of the Maryland Board of Physicians. The work requires travel to various locations throughout the state such as medical offices and health care facilities.
Positions in this classification are evaluated by using the classification job evaluation methodology. The use of this method involves comparing the assigned duties and responsibilities of a position to the job criteria found in the Nature of Work and Examples of Work sections of the classification specification.
The MBP Compliance Analyst Senior, Investigations is differentiated from the MBP Compliance Analyst, Investigations in that the MBP Compliance Analyst Senior, Investigations investigates complex cases and complaints involving specialized and sub-specialized areas of medical practice or significantly advanced medical theories, concepts and principles and may also include multiple violations presenting several medical and legal issues while the MBP Compliance Analyst, Investigations performs the full range of duties and responsibilities under general supervision. The MBP Compliance Analyst Senior, Investigations is differentiated from the MBP Compliance Analyst Lead, Investigations in that the MBP Compliance Analyst Lead, Investigations assigns, reviews and approves the work of and trains lower-level MBP Compliance Analysts, Investigations and MBP Compliance Analyst Associates, Investigations.
Investigates complex cases and complaints against Physicians and allied health care providers that may involve violations of the Maryland Medical Practice Act and involve specialized and sub-specialized areas of medical practice or significantly advanced medical theories, concepts and principles and may also include multiple violations presenting several medical and legal issues;
Examines documents and records, conducts research and analysis of preliminary information and determines the validity of complaints;
Identifies relevant issues, determines grounds of case, regulations and Board precedents applicable to the facts of the case and determines case strategy and investigative approach;
Conducts research to understand all aspects of the complaint, including relevant medical and legal issues;
Examines legal and medical records relevant to investigations;
Identifies and interviews complainants, respondents, and witnesses and obtains signed statements when warranted;
Prepares and serves subpoenas and other related official documents for the collection of physical and documentary evidence;
Coordinates, identifies, and collects physical evidence and reports information using camera, telephone and other evidence collection tools to preserve the chain of custody and prepare a completed investigation file in accordance with established procedures;
Consults with regulatory or law enforcement agencies, and expert witnesses on an as needed basis;
Conducts field assignments, announced and unannounced site visits and medical office inspections to cite and record violations of the Maryland Medical Practice Act;
Determines eligibility of applicants for licensure;
Prepares clear and concise reports and memoranda related to the process and findings of the investigation for peer review, supervisory review, to present to the Board, sub-committees, prosecutors and Executive staff;
Acts as a liaison between the Board, respondents and their attorney and maintains records of all communications and other related aspects of the investigations;
Assists in the development and maintenance of the central repository of correspondence, guidelines, formatted templates and contact information used by the Compliance Unit;
Coordinates and assists in case preparation with the Office of the Attorney General;
Testifies at administrative hearings and other court proceedings;
Conducts debriefings on closed cases to identify areas in need of improvement and assists in ensuring that each case is reviewed by the Prosecutor before being presented to the Board for charging;
Performs other related duties.
Experience: Seven years of experience conducting investigations in the area of health care, insurance, medical malpractice or other related experience in investigative areas as defined by the Maryland Board of Physicians.

1. Candidates may substitute the possession of a Bachelor's degree from an accredited college or university and three years of experience conducting investigations in the areas of health care, insurance, medical malpractice or other related investigative experience as defined by Maryland Board of Physicians for the required experience.
2. Candidates may substitute the possession of a Master’s degree from an accredited college or university for up to five years of the required experience.
3. Candidates may substitute the possession of a Juris Doctorate degree from an accredited college or university for the required experience.
4. Candidates may substitute U.S. Armed Forces military service experience as a commissioned officer in Legal or Investigator classification or Legal or Investigator specialty codes in the Investigation field of work on a year-for-year basis for the required experience.

This is a Skilled Service classification in the State Personnel Management System. All positions in this classification are Skilled Service positions. Some positions in Skilled Service classifications may be designated Special Appointment in accordance with the State Personnel and Pensions Article, Section 6-405, Annotated Code of Maryland.
This classification is not assigned to a bargaining unit, as indicated by the designation of S (Supervisor), M (Manager), T (Agency Head), U (Board or Commission Member), W (Student), X (Used by Agency or Excluded by Executive Order), or Z (Confidential). As provided by State Personnel and Pensions Article, Section 3-102, special appointment, temporary, contractual, supervisory, managerial and confidential employees are excluded from collective bargaining. Additionally, certain executive branch agencies are exempt from collective bargaining and all positions in those agencies are excluded from collective bargaining.
