In accordance with the Insurance Article, Title 2. Maryland Insurance Administration, Section 104, (a) Deputy Commissioner:
(1) Subject to the approval of the Governor, the Commissioner shall appoint a Deputy Commissioner.
(2) The Deputy Commissioner is in the executive service of the State Personnel Management System and is entitled to compensation in accordance with the State budget.
(3) The Deputy Commissioner shall be covered by a surety bond in the form and amount required by law.
(4) The Deputy Commissioner shall exercise the powers and perform the duties vested by law in the Commissioner:
(i) if the office of the Commissioner is vacant; or
(ii) if for any reason the Commissioner is absent or unable to exercise the powers and perform the duties of office.

This is an Executive Service classification in the State Personnel Management System. All positions in this classification are Executive Service positions.
This classification is not assigned to a bargaining unit, as indicated by the designation of S (Supervisor), M (Manager), T (Agency Head), U (Board or Commission Member), W (Student), X (Used by Agency or Excluded by Executive Order), or Z (Confidential). As provided by State Personnel and Pensions Article, Section 3-102 Annotated Code of Maryland, special appointment, temporary, contractual, supervisory, managerial and confidential employees are excluded from collective bargaining. Additionally, certain executive branch agencies are exempt from collective bargaining and all positions in those agencies are excluded from collective bargaining.
